                                     AN ACT

     1  Amending the act of December 18, 1984 (P.L.1004, No.204),
     2     entitled "An act extending benefits to police chiefs or heads
     3     of police departments of political subdivisions of the
     4     Commonwealth who have been removed from bargaining units by
     5     the Pennsylvania Labor Relations Board," further providing
     6     for definitions and for salary of supervisory personnel.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1 of the act of December 18, 1984
    10  (P.L.1004, No.204), entitled "An act extending benefits to
    11  police chiefs or heads of police departments of political
    12  subdivisions of the Commonwealth who have been removed from
    13  bargaining units by the Pennsylvania Labor Relations Board," is
    14  repealed:
    15  [Section 1.  Salary of nonunion police officers.
    16     Except in cities of the first and second class, the chief,
    17  superintendent or commissioner of police and other ranking
    18  officers in a political subdivision of the Commonwealth who have
    19  been removed from bargaining units under the act of June 24,

     1  1968 (P.L.237, No.111), referred to as the Policemen and Firemen
     2  Collective Bargaining Act, by rulings of the Pennsylvania Labor
     3  Relations Board shall receive not less than the same dollar
     4  increase including fringe benefits excluding overtime and
     5  festive holiday pay as received by the highest ranking police
     6  officer participating in the bargaining unit.]
     7     Section 2.  The act is amended by adding sections to read:
     8  Section 1.1.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Bargaining unit."  A collective bargaining unit as provided
    13  under the act of June 24, 1968 (P.L.237, No.111), referred to as
    14  the Policemen and Firemen Collective Bargaining Act.
    15     "Supervisory personnel."  The chief, superintendent or
    16  commissioner of police and other ranking police officers in a
    17  political subdivision of the Commonwealth, except that this term
    18  does not apply to those individuals employed by cities of the
    19  first and second class.
    20  Section 1.2.  Salary of supervisory personnel.
    21     (a)  Pay and benefits.--Supervisory personnel who are not
    22  members of bargaining units shall receive not less than the same
    23  dollar increase including fringe benefits excluding overtime and
    24  festive holiday pay as received by the highest ranking police
    25  officer participating in the bargaining unit.
    26     (b)  Additional persons.--Supervisory personnel who have been
    27  removed from bargaining units by rulings of the Pennsylvania
    28  Labor Relations Board shall be subject to the provisions of
    29  subsection (a).
    30     (c)  Future personnel.--Supervisory personnel who are not

     1  members of bargaining units and who have not been removed from
     2  bargaining units by rulings of the Pennsylvania Labor Relations
     3  Board shall be subject to the provisions of subsection (a),
     4  unless the governing body of the political subdivision, by
     5  majority vote of the members elected to the governing body,
     6  provides for a lesser annual increase or for no annual increase.
     7     Section 3.  (a)  Section 1.2(a) of the act shall apply to
     8  supervisory personnel who are appointed to their positions prior
     9  to the effective date of this section.
    10     (b)  Sections 1.2(b) and (c) of the act shall apply to
    11  supervisory personnel who are appointed to their positions on or
    12  after the effective date of this section.
    13     Section 4.  This act shall take effect in 60 days.
