                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for the offense of
     3     furnishing over-the-counter medication to minors.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 6310.8.  Furnishing over-the-counter medication to minors.
     9     (a)  Offense defined.--Any person who knowingly furnishes any
    10  over-the-counter medication to a minor for nonmedical purposes,
    11  which causes or may cause substantial impairment, commits a
    12  misdemeanor of the first degree.
    13     (b)  Alternate grading.--If the substantial impairment under
    14  subsection (a) results in serious bodily injury or death, the
    15  person commits a felony of the third degree.
    16     Section 2.  This act shall take effect in 60 days.
