                                     AN ACT

     1  Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
     2     Statutes, defining "local government unit"; and providing for
     3     general testing and inspections.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4102 of Title 3 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a definition to read:
     8  § 4102.  Definitions.
     9     The following words and phrases when used in this chapter
    10  shall have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     * * *
    13     "Local government unit."  Any city, borough, township or town
    14  or any home rule municipality, optional charter municipality or
    15  similar general purpose unit of government which may be created
    16  or authorized by statute.

    18     Section 2.  Section 4112 of Title 3 is amended by adding a

     1  subsection to read:
     2  § 4112.  General testing and inspections.
     3     * * *
     4     (b.1)  Local government unit inspection of parking meters.--
     5  Notwithstanding subsections (a) and (b), if a local government
     6  unit or authority organized by a local government unit makes
     7  commercial use of parking meters, it shall be the duty of the
     8  local government unit at least once within a 36-month period, or
     9  more frequently if deemed necessary, to assure that all such
    10  commercially used parking meters are inspected and tested to
    11  ascertain if they are correct. The local government unit may
    12  accept reports of Certified Examiners of Weights and Measures as
    13  sufficient to meet the inspection and testing requirements of
    14  this subsection if:
    15         (1)  the inspection and testing is performed in
    16     accordance with all applicable standards and procedures
    17     adopted under section 4110(a)(4); and
    18         (2)  State inspectors of weights and measures conduct
    19     inspection and testing of a sample of devices inspected and
    20     tested by Certified Examiners of Weights and Measures.

    22     Section 3.  This act shall take effect in 60 days.
