           PREPAREDNESS, HOUSE OF REPRESENTATIVES, AS AMENDED,
           OCTOBER 3, 2007

                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for educational
     3     leave of absence.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 7313 of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 7313.  Educational leave of absence.
     9     Whenever any member of the Pennsylvania National Guard or
    10  other reserve component of the armed forces of the United States
    11  shall be called or ordered to active duty, other than active
    12  duty for training, including, in the case of members of the


     1  Pennsylvania National Guard, active State duty, the educational
     2  institution in which the member is enrolled shall grant the
     3  member or their spouse a military leave of absence from their
     4  education. [Persons] Members and spouses on military leave of
     5  absence from their educational institution shall be entitled,
     6  upon THE MEMBER'S release from military duty, to be restored to   <--
     7  the educational status they had attained prior to [their] THE     <--
     8  MEMBER being ordered to military duty without loss of academic
     9  credits earned, scholarships or grants awarded or tuition and
    10  other fees paid prior to the commencement of the military duty.
    11  It shall be the duty of the educational institution to refund
    12  tuition or fees paid or to credit the tuition and fees to the
    13  next semester or term after the termination of the educational
    14  military leave of absence at the option of the student.
    15     Section 2.  This act shall take effect in 60 days.
