                                     AN ACT

     1  Amending Title 62 (Procurement) of the Pennsylvania Consolidated
     2     Statutes, providing for construction safety and health
     3     training.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 62 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3914.  Construction safety and health training.
     9     All contracts entered into by a government agency in excess
    10  of $250,000 shall contain a clause requiring all laborers,
    11  workers and mechanics employed in the performance of the
    12  contract on the public work site, by the contractor, sub-
    13  contractor or other person doing or contracting to do the whole
    14  or a part of the work contemplated by the contract, to be
    15  certified prior to performing any work on the project as having
    16  successfully completed a course in construction safety and
    17  health approved by the United States Department of Labor's
    18  Occupational Safety and Health Administration that is at least

     1  ten hours in duration. Proof of certification by all laborers,
     2  workers and mechanics employed by the contractor, sub-contractor
     3  or other person doing or contracting to do the whole or a part
     4  of the work contemplated by the contract shall be submitted to
     5  the department by the contractor, sub-contractor or other person
     6  doing or contracting to do the whole or a part of the work
     7  contemplated by the contract and kept on file.
     8     Section 2.  This act shall take effect in 60 days.
