AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and the public schools for the 4 fiscal year July 1, 2007, to June 30, 2008, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 2007; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the 12 Tuition Payment Fund, the Banking Department Fund, the 13 Firearm Records Check Fund, the Ben Franklin Technology 14 Development Authority Fund and the Tobacco Settlement Fund to 15 the Executive Department; to provide appropriations from the 16 Judicial Computer System Augmentation Account to the Judicial 17 Department for the fiscal year July 1, 2007, to June 30, 18 2008; to provide appropriations from the Motor License Fund 19 for the fiscal year July 1, 2007, to June 30, 2008, for the 20 proper operation of the several departments of the 21 Commonwealth and the Pennsylvania State Police authorized to 22 spend Motor License Fund moneys; to provide for the 23 appropriation of Federal funds to the Executive Department of 24 the Commonwealth and for the payment of bills remaining 25 unpaid at the close of the fiscal year ending June 30, 2007; 26 to provide for the additional appropriation of Federal and 27 State funds from the General Fund, the State Lottery Fund and 28 the Pharmaceutical Assistance Contract for the Elderly Fund 29 for the Executive, Legislative and Judicial Departments of 30 the Commonwealth for the fiscal year July 1, 2006, to June 31 30, 2007, and for the payment of bills incurred and remaining 32 unpaid at the close of the fiscal year ending June 30, 2006. 33 TABLE OF CONTENTS 34 PART I. Effective date. 12 The General Assembly of the Commonwealth of Pennsylvania 13 hereby enacts as follows: 14 PART I 15 GENERAL PROVISIONS 16 Section 101. Short title.--This act shall be known and may 17 be cited as the General Appropriation Act of 2007. 18 Section 102. Definitions.--The following words and phrases 19 when used in this act shall have the meanings given to them in 20 this section unless the context clearly indicates otherwise: 21 "Employees." Includes all directors, superintendents, bureau 22 or division chiefs, assistant directors, assistant 23 superintendents, assistant chiefs, experts, scientists, 24 engineers, surveyors, draftsmen, accountants, secretaries, 25 auditors, inspectors, examiners, analysts, statisticians, 26 marshals, clerks, stenographers, bookkeepers, messengers and 27 other assistants in any department, board or commission. 28 "Expenses" and "maintenance." Includes all printing, binding 29 and stationery, food and forage, materials and supplies, 30 traveling expenses, training, motor vehicle supplies and 20070H1286B2346 - 10 -
1 repairs, freight, express and cartage, postage, telephones and 2 telegraph rentals and toll charges, newspaper advertising and 3 notices, public advertising by or through any medium, fuel, 4 light, heat, power and water, minor construction and renovation, 5 repairs or reconstruction of equipment, buildings and 6 facilities, rent of real estate and equipment, premiums on 7 workers' compensation, insurance premiums on policies of 8 liability insurance, insurance premiums on medical payment 9 insurance and surety bonds for volunteer workers, premiums on 10 employee group life insurance and employee and retired employee 11 group hospital and medical insurance, payment of Commonwealth 12 share of Social Security taxes and unemployment compensation 13 costs for State employees, the purchase of replacement or 14 additional equipment and machinery and all other incidental 15 costs and expenses, including payment to the Department of 16 General Services of mileage and other charges for the use of 17 automobiles and rental payments for permanently assigned 18 automobiles and of expenses or costs of services incurred 19 through the Purchasing Fund. The term "expenses" also shall 20 include the medical costs for the treatment of inmates of State 21 institutions when the inmate must be transferred to an outside 22 hospital, provided, that in no case shall the State institution 23 pay more for patient care than that provided under the State 24 medical assistance program. 25 Section 103. Abbreviations.--The following abbreviations 26 when used in this act shall have the meanings given to them in 27 this section unless the context clearly indicates otherwise: 28 "ARC." 1 General Fund to the several hereinafter named agencies of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth for the payment of salaries, wages or other 4 compensation and travel expenses of the duly elected or 5 appointed officers and employees of the Commonwealth, for the 6 payment of fees for contractual services rendered, for the 7 purchase or rental of goods and services, printing, public 8 advertising by or through any medium, equipment, land and 9 buildings and for payment of any other expenses, as provided by 10 law or by this act, necessary for the proper conduct of the 11 duties, functions and activities and for the purposes 12 hereinafter set forth for the fiscal year beginning July 1, 13 2007, and for the payment of bills incurred and remaining unpaid 14 at the close of the fiscal year ending June 30, 2007. 15 (b) State Lottery Fund.--The following sums set forth in 16 this act, or as much thereof as may be necessary, are hereby 17 specifically appropriated from the State Lottery Fund to the 18 several hereinafter named agencies of the Executive Department 19 of the Commonwealth for the payment of salaries, wages or other 20 compensation and travel expenses of the duly appointed officers 21 and employees of the Commonwealth, for the payment of fees for 22 contractual services rendered, for the purchase or rental of 23 goods and services and for payment of any other expenses, as 24 provided by law or by this act, necessary for the proper conduct 25 of the duties, functions and activities and for the purposes 26 hereinafter set forth for the fiscal year beginning July 1, 27 2007, and for the payment of bills incurred and remaining unpaid 28 at the close of the fiscal year ending June 30, 2007. 29 (c) Energy Conservation and Assistance Fund.--The following 30 sums set forth in this act, or as much thereof as may be 20070H1286B2346 - 13 -
1 necessary, are hereby specifically appropriated from the Energy 2 Conservation and Assistance Fund to the several hereinafter 3 named agencies of the Executive Department of the Commonwealth 4 for the payment of fees for contractual services rendered, for 5 the purchase or rental of goods and services and for the payment 6 of any other expenses, as provided by law or by this act, 7 necessary for the proper conduct of the duties, functions and 8 activities and for the purposes hereinafter set forth for the 9 fiscal year beginning July 1, 2007, and for the payment of bills 10 incurred and remaining unpaid at the close of the fiscal year 11 ending June 30, 2007. 12 (d) Judicial Computer System Augmentation Account.--The 13 following sums set forth in this act, or as much thereof as may 14 be necessary, are hereby specifically appropriated from the 15 restricted receipt account established within the General Fund, 16 known as the Judicial Computer System Augmentation Account, to 17 the Judicial Department of the Commonwealth for the payment of 18 salaries, wages or other compensation and travel expenses, for 19 the payment of fees for contractual services rendered, for the 20 purchase or rental of goods and services and for the payment of 21 any other expenses, as provided by law or by this act, necessary 22 for the proper conduct of the duties, functions and activities 23 and for the purposes hereinafter set forth for the fiscal year 24 beginning July 1, 2007, and for the payment of bills incurred 25 and remaining unpaid at the close of the fiscal year ending June 26 30, 2007. 27 (e) Emergency Medical Services Operating Fund.--The 28 following sums set forth in this act, or as much thereof as may 29 be necessary, are hereby specifically appropriated from the 30 Emergency Medical Services Operating Fund to the several 20070H1286B2346 - 14 -
1 hereinafter named agencies of the Executive Department of the 2 Commonwealth for the payment of fees for contractual services 3 rendered, for the purchase or rental of goods and services and 4 for the payment of any other expenses, as provided by law or by 5 this act, necessary for the proper conduct of the duties, 6 functions and activities and for the purposes hereinafter set 7 forth for the fiscal year beginning July 1, 2007, and for the 8 payment of bills incurred and remaining unpaid at the close of 9 the fiscal year ending June 30, 2007. 10 (f) The State Stores Fund.--The following sums set forth in 11 this act, or as much thereof as may be necessary, are hereby 12 specifically appropriated from The State Stores Fund to the 13 hereinafter named agency of the Executive Department of the 14 Commonwealth for the payment of salaries, wages or other 15 compensation and travel expenses of the duly appointed officers 16 and employees of the Commonwealth, for the payment of fees for 17 contractual services rendered, for the purchase or rental of 18 goods and services and for the payment of any other expenses, as 19 provided by law or by this act, necessary for the proper conduct 20 of the duties, functions and activities and for the purposes 21 hereinafter set forth for the fiscal year beginning July 1, 22 2007, and for the payment of bills incurred and remaining unpaid 23 at the close of the fiscal year ending June 30, 2007. 24 (g) Motor License Fund.--The following sums, or as much 25 thereof as may be necessary, are hereby appropriated from the 26 Motor License Fund to the hereinafter named agencies of the 27 Executive Department for the payment of salaries, wages and 28 other compensation and travel expenses of the duly elected or 29 appointed officers and employees of the Commonwealth, for 30 contractual services and other expenses necessary for the proper 20070H1286B2346 - 15 -
1 conduct of the duties, functions and activities for the purposes 2 hereinafter set forth for the fiscal year beginning July 1, 3 2007, and for the payment of bills incurred and remaining unpaid 4 at the close of the fiscal year ending June 30, 2007. 5 (h) Aviation Restricted Revenue Account.--The following 6 sums, or as much thereof as may be necessary, are hereby 7 appropriated from the Aviation Restricted Revenue Account in the 8 Motor License Fund to the hereinafter named agencies of the 9 Executive Department for the purposes set forth herein for the 10 fiscal year beginning July 1, 2007, and for the payment of bills 11 incurred and remaining unpaid at the close of the fiscal year 12 ending June 30, 2007. 13 (i) Hazardous Material Response Fund.--The following sums 14 set forth in this act, or as much thereof as may be necessary, 15 are hereby specifically appropriated from the Hazardous Material 16 Response Fund to the several hereinafter named agencies of the 17 Executive Department of the Commonwealth for the payment of fees 18 for contractual services rendered, for the purchase or rental of 19 goods and services and for the payment of any other expenses, as 20 provided by law or by this act, necessary for the proper conduct 21 of the duties, functions and activities and for the purposes 22 hereinafter set forth for the fiscal year beginning July 1, 23 2007, and for the payment of bills incurred and remaining unpaid 24 at the close of the fiscal year ending June 30, 2007. 25 (j) Milk Marketing Fund.--The following sums set forth in 26 this act, or as much thereof as may be necessary, are hereby 27 specifically appropriated from the Milk Marketing Fund to the 28 several hereinafter named agencies of the Executive Department 29 of the Commonwealth for the payment of salaries, wages or other 30 compensation and travel expenses of the duly appointed officers 20070H1286B2346 - 16 -

1 (c) Community Services Block Grant.--The Community Services 2 Block Grant (CSBG) is to provide a range of services and 3 activities having a measurable and potentially major impact on 4 the causes of poverty in the community or those areas of the 5 community where poverty is a particularly acute problem. In 6 addition, new focus may be placed on the unemployed, both old 7 and new. Local agencies may lower their eligibility requirements 8 for recipients to three months to allow greater flexibility to 9 assure proper consideration of each recipient. 10 (d) Preventive Health and Health Services Block Grant.--The 11 Preventive Health and Health Services Block Grant (PHHSBG) is 12 for the provision of preventive health and other health services 13 related to emergency medical systems, health initiative grants, 14 comprehensive public health, hypertension, fluoridation, health 15 education, risk reduction, home health, rape crisis and domestic 16 violence services. 17 (e) Maternal and Child Health Services Block Grant.--The 18 Maternal and Child Health Services Block Grant (MCHSBG) is to 19 enable states to maintain and strengthen their leadership in 20 planning, promoting, coordinating and evaluating health care for 21 pregnant women, mothers, infants and children, and children with 22 special health care needs and in providing health services for 23 mothers and children who do not have access to adequate health 24 care. 25 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 26 Income Home Energy Assistance Block Grant (LIHEABG) is to help 27 lessen the impact of the high cost of energy on low-income 28 families and individuals, including energy efficiency grants for 29 low-income dwellings. No less than 15% of the LIHEABG funds 30 received shall be used for weatherization. LIHEABG funds 20070H1286B2346 - 21 -

Prior laws unaffected.--This act is not 14 intended to be inconsistent with or to repeal any provision of 15 any act enacted at this or any prior session of the General 16 Assembly regulating the purchase of supplies, the ordering of 17 printing and binding, the purchase, maintenance and use of 18 automobiles, the method of making payments from the State 19 Treasury for any purpose or the functioning of any 20 administrative department, board or commission. 21 Section 1792. Compliance with other law before funds 22 available.--No appropriation made by this part to any 23 department, board, commission or agency of the Executive 24 Department shall be available unless and until the department, 25 board, commission or agency has complied with sections 615 and 26 616 of the act of April 9, 1929 (P.L.177, No.175), known as The 27 Administrative Code of 1929. 28 Section 1793. Contracts prerequisite to encumbering or 29 committing funds.--Funds for the purchase of supplies, materials 30 and equipment shall not be deemed to be committed or encumbered 20070H1286B2346 - 207 -
1 until contracts covering the purchase have been entered into 2 with the vendors. 3 Section 1794. Minority business set-asides.--(a) Each 4 department or other instrumentality of the Commonwealth listed 5 in Subpart B authorized to contract for buildings, highways, 6 commodities, equipment, supplies or services shall report to the 7 General Assembly all information pertinent to anticipated 8 procurement needs at the beginning of each fiscal year and each 9 fiscal quarter thereafter. 10 (b) As used in this section, the term "minority business" 11 means a minority business enterprise as defined in the act of 12 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 13 Minority Business Development Authority Act. 14 Section 1795. Appropriation of funds from miscellaneous 15 sources.--(a) In addition to the amounts appropriated by this 16 part, moneys received in payment for food and household supplies 17 furnished to employees and other persons, except inmates, by an 18 institution, and moneys received from the proceeds from the sale 19 of any products of the soil, meats, livestock, timber or other 20 materials sold by the department shall be paid into the General 21 Fund and are hereby appropriated out of the General Fund to the 22 several respective institutions for the operation and 23 maintenance of the institutions. 24 (b) In addition to the amounts appropriated by this part, 25 all moneys received from any other source, except the Federal 26 Government, as contributions for the programs provided herein or 27 as payment for services or materials furnished by one 28 institution to another, except those collections designated as 29 revenues, shall be paid into the General Fund and are hereby 30 appropriated out of the General Fund for the purposes of the 20070H1286B2346 - 208 -
1 respective appropriations. 2 (c) In addition to any funds specifically appropriated by 3 this part, all moneys received by a department or agency of the 4 Commonwealth from any other sources, except the Federal 5 Government, as contributions or supplements to the department or 6 agency for a program or administration of an act included in 7 this part shall be paid into the General Fund and credited to 8 the appropriation for that program or administration of the act. 9 Section 1796. Lapsing of unused funds.--(a) Except as 10 otherwise provided by law or by this section, that part of all 11 appropriations in Part XVII unexpended, uncommitted or 12 unencumbered as of June 30, 2007, shall automatically lapse as 13 of that date. 14 (b) The appropriation in section 1711 to the Attorney 15 General for a joint local-State firearm task force in a city of 16 the first class shall be a continuing appropriation until June 17 30, 2008. 18 (c) The appropriations in Subpart D to the Legislative 19 Department shall be continuing appropriations. 20 (d) The appropriations in Subpart E to the Judicial 21 Department for the courts of common pleas shall be a continuing 22 appropriation. 23 Section 1797. Construction with prior appropriation acts.-- 24 Any appropriation in Subparts B, C, D, E and F of this part 25 which is the same or similar to any appropriation in the act of 26 July 2, 2006 (P.L.1640, No.2A), known as the General 27 Appropriation Act of 2006, or the act of July 2, 2006 (P.L. 28 , No.6A) entitled, "An act making an appropriation from a 29 restricted revenue account within the General Fund and from 30 Federal augmentation funds to the Pennsylvania Public Utility 20070H1286B2346 - 209 -
1 Commission," shall replace that appropriation. 2 Section 1798. Deduction of expended appropriations under 3 prior law.--Any money which has been appropriated and expended 4 under the act of July 2, 2006 (P.L.1640, No.2A), known as the 5 General Appropriation Act of 2006, or the act of July 2, 2006 6 (P.L. , No.6A) entitled, "An act making an appropriation 7 from a restricted revenue account within the General Fund and 8 from Federal augmentation funds to the Pennsylvania Public 9 Utility Commission," shall be deducted from the corresponding 10 appropriation in this part. 11 PART XVIII 12 SPECIAL PROVISIONS FOR FEDERAL FUNDS 13 FOR 2007-2008 14 Section 1801. General Fund repository for Federal funds.-- 15 All moneys received from the Federal Government as contributions 16 or supplements to the departments or agencies of the 17 Commonwealth or the programs herein provided shall be paid into 18 the General Fund. 19 Section 1802. Limitation on encumbering or spending Federal 20 funds.--Federal funds shall be encumbered or spent only to the 21 extent that such funds are estimated as being available during 22 the fiscal year of the Commonwealth. 23 Section 1803. Appropriation of prior unspent Federal 24 funds.--(a) Any Federal money which has been previously 25 appropriated by the General Assembly and authorized or allocated 26 by the Federal Government but remains unspent from prior fiscal 27 years and will not be renewed for fiscal year 2007-2008 is 28 hereby appropriated. 29 (b) The Federal appropriations to the Department of Public 30 Welfare include any prior earnings that may be received during 20070H1286B2346 - 210 -
1 fiscal year 2007-2008. In addition to the amounts specifically 2 appropriated herein to the Department of Public Welfare, all 3 moneys appropriated from the Federal Government during any 4 previous fiscal year which are expected to be received as 5 reimbursements may be carried forward until June 30, 2008, to 6 the extent that obligations are carried forward. In addition, 7 any reimbursements actually received to support such obligations 8 may also be carried forward. 9 Section 1804. Subgrants between Federal fund 10 appropriations.--Subgrants may be made between appropriations 11 without further approval of the General Assembly. The Secretary 12 of the Budget shall submit a list of subgrants to the chairman 13 and minority chairman of the Appropriations Committee of the 14 Senate and the chairman and minority chairman of the 15 Appropriations Committee of the House of Representatives 16 quarterly. No subgrant to a State agency, however, may be made 17 from a restricted receipt account without a specific 18 appropriation by the General Assembly. 19 Section 1805. Utilization of emergency Federal funds.--(a) 20 Federal funds available for costs and damages resulting from 21 natural disasters or civil disobedience may be added to an 22 appropriation contained in this act or to funds appropriated or 23 may be used for the purposes prescribed by the Federal 24 Government. 25 (b) In addition to the moneys appropriated by this act, all 26 moneys received from the Federal Government for the purpose of 27 disaster assistance or relief, or other moneys received as a 28 direct result of terrorist acts, moneys for homeland security 29 and defense and moneys for avian flu/pandemic preparedness shall 30 be paid into the General Fund and are hereby appropriated out of 20070H1286B2346 - 211 -
1 the General Fund to the departments, boards, commissions or 2 agencies designated by the Governor. 3 (c) In the event of any emergency situation in which the 4 General Assembly cannot act in sufficient time, the Governor is 5 authorized through executive authorization to provide up to 6 $10,000,000 in Federal funds to alleviate the emergency 7 situation. For the purposes of this section, "emergency" is 8 defined as any situation in which there is a chance of or which 9 may result in substantial human suffering. 10 Section 1806. Transfer of funds from TANFBG to CCDFBG and 11 SSBG.--In accordance with Federal law which permits the transfer 12 of funds from the TANFBG to the CCDFBG and SSBG, the Department 13 of Public Welfare, upon approval of the Secretary of the Budget, 14 may make such transfers of funds provided that any such transfer 15 will not result in a deficit in any appropriation from which 16 funds are transferred. The Secretary of the Budget shall provide 17 ten days prior notification of any such transfers to the 18 chairman and the minority chairman of the Appropriations 19 Committee of the Senate and the chairman and minority chairman 20 of the Appropriations Committee of the House of Representatives. 21 PART XIX 22 MISCELLANEOUS PROVISIONS FOR 2007-2008 23 Section 1901. Contracts prerequisite to encumbering or 10 committing funds.--Funds available to agencies, boards, 11 departments, commissions or other governmental entities under 12 this act for the procurement of supplies, services or 13 construction shall not be available for payment of or to be 14 committed to or encumbered for payment of any such procurement 15 unless and until the agency, board, department or other 16 governmental entity has complied with all of the requirements 17 applicable to the procurement that are set out in 62 Pa.C.S. 18 (relating to procurement) and in the policies, procedures and 19 regulations instituted in accordance with that code. 20 Section 1904. Lapsing of unused funds.--(a) Except as 27 otherwise provided by law or by this section, that part of all 28 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 29 XI, XII, XIII, XIV, XV and XVI unexpended, uncommitted or 30 unencumbered as of June 30, 2008, shall automatically lapse as 20070H1286B2346 - 214 -
1 of that date. 2 (b) The appropriation in Part II to the Department of 3 Community and Economic Development for family savings accounts 4 shall be a continuing appropriation. 5 (c) The appropriation in Part II to the Pennsylvania 6 Emergency Management Agency for June 2006 Flood Disaster - 7 Public Assistance shall be a continuing appropriation. 8 (d) The appropriations in Part II to the Legislative 9 Department shall be continuing appropriations. 10 (e) The appropriations in Part II to the Supreme Court for 11 the unified judicial security programs shall be a continuing 12 appropriation. 13 (f) The appropriation in Part II for county court 14 reimbursements for the gun courts shall be a continuing 15 appropriation until June 30, 2009. 16 Section 1907. Appellate courts appropriation contingency.-- 17 The funds appropriated in Part II to the Supreme, Superior and 18 Commonwealth Courts for justice and judge expenses are 19 contingent upon a vouchered expense account plan being continued 20 by the Supreme Court. 21 Section 1908. Transfer of excess funds.--The Governor may 22 transfer any excess money in those funds receiving proceeds of 23 Commonwealth of Pennsylvania general obligation bonds in excess 24 of the amount necessary for the purposes for which the bonds 25 were issued to the appropriate sinking fund for payment of debt 26 service due on outstanding bonds. If such excess funds, together 27 with any available balance, exceed the amount of debt service 28 remaining to be paid, the funds shall be transferred to the 29 General Fund or to the appropriate special fund responsible for 30 such debt service. 20070H1286B2346 - 215 -
1 PART XX 2 EFFECTIVE DATE 3 Section 2001. Retroactivity.--This act shall be retroactive 4 as follows: 5 (1) The provisions of Part XVII of this act shall be 6 retroactive to July 1, 2006. 7 (2) Except as provided in paragraph (1), if the date of 8 enactment is after July 1, 2007, the remainder of this act 9 shall be retroactive to July 1, 2007. 10 Section 2002.
