AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 2007, to June 30, 2008, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 2007; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the 12 Tuition Payment Fund, the Banking Department Fund, the 13 Firearm Records Check Fund, the Ben Franklin Technology 14 Development Authority Fund, the Tobacco Settlement Fund and 15 the Health Care Provider Retention Account to the Executive 16 Department; to provide appropriations from the Judicial 17 Computer System Augmentation Account to the Judicial 18 Department for the fiscal year July 1, 2007, to June 30, 19 2008; to provide appropriations from the Motor License Fund 20 for the fiscal year July 1, 2007, to June 30, 2008, for the 21 proper operation of the several departments of the 22 Commonwealth and the Pennsylvania State Police authorized to 23 spend Motor License Fund moneys; to provide for the 24 appropriation of Federal funds to the Executive Department of 25 the Commonwealth and for the establishment of restricted 26 receipt accounts for the fiscal year July 1, 2007, to June 27 30, 2008, and for the payment of bills remaining unpaid at 28 the close of the fiscal year ending June 30, 2007; to provide 29 for the additional appropriation of Federal and State funds 30 from the General Fund, the State Lottery Fund and the 31 Pharmaceutical Assistance Contract for the Elderly Fund for

Effective date. 20 The General Assembly of the Commonwealth of Pennsylvania 21 hereby enacts as follows: 22 PART I 23 GENERAL PROVISIONS 24 Section 101. Short title.--This act shall be known and may 25 be cited as the General Appropriation Act of 2007. 26 Section 102. Definitions.--The following words and phrases 27 when used in this act shall have the meanings given to them in 28 this section unless the context clearly indicates otherwise: 29 "Employees." Includes all directors, superintendents, bureau 30 or division chiefs, assistant directors, assistant 20070H1286B1907 - 8 -
1 superintendents, assistant chiefs, experts, scientists, 2 engineers, surveyors, draftsmen, accountants, secretaries, 3 auditors, inspectors, examiners, analysts, statisticians, 4 marshals, clerks, stenographers, bookkeepers, messengers and 5 other assistants in any department, board or commission. 6 "Expenses" and "maintenance." Includes all printing, binding 7 and stationery, food and forage, materials and supplies, 8 traveling expenses, training, motor vehicle supplies and 9 repairs, freight, express and cartage, postage, telephones and 10 telegraph rentals and toll charges, newspaper advertising and 11 notices, public advertising by or through any medium, fuel, 12 light, heat, power and water, minor construction and renovation, 13 repairs or reconstruction of equipment, buildings and 14 facilities, rent of real estate and equipment, premiums on 15 workers' compensation, insurance premiums on policies of 16 liability insurance, insurance premiums on medical payment 17 insurance and surety bonds for volunteer workers, premiums on 18 employee group life insurance and employee and retired employee 19 group hospital and medical insurance, payment of Commonwealth 20 share of Social Security taxes and unemployment compensation 21 costs for State employees, the purchase of replacement or 22 additional equipment and machinery and all other incidental 23 costs and expenses, including payment to the Department of 24 General Services of mileage and other charges for the use of 25 automobiles and rental payments for permanently assigned 26 automobiles and of expenses or costs of services incurred 27 through the Purchasing Fund. The term "expenses" also shall 28 include the medical costs for the treatment of inmates of State 29 institutions when the inmate must be transferred to an outside 30 hospital: Provided, That in no case shall the State institution 20070H1286B1907 - 9 -
1 pay more for patient care than that provided under the State 2 medical assistance program. 3 Section 103. Abbreviations.--The following abbreviations 4 when used in this act shall have the meanings given to them in 5 this section unless the context clearly indicates otherwise: 6 "ARC." State appropriations.--(a) General Fund.--The 7 following sums set forth in this act, or as much thereof as may 8 be necessary, are hereby specifically appropriated from the 9 General Fund to the several hereinafter named agencies of the 10 Executive, Legislative and Judicial Departments of the 11 Commonwealth for the payment of salaries, wages or other 12 compensation and travel expenses of the duly elected or 13 appointed officers and employees of the Commonwealth, for the 14 payment of fees for contractual services rendered, for the 15 purchase or rental of goods and services, printing, public 16 advertising by or through any medium, equipment, land and 17 buildings and for payment of any other expenses, as provided by 18 law or by this act, necessary for the proper conduct of the 19 duties, functions and activities and for the purposes 20 hereinafter set forth for the fiscal year beginning July 1, 21 2007, and for the payment of bills incurred and remaining unpaid 22 at the close of the fiscal year ending June 30, 2007. 23 (b) State Lottery Fund.--The following sums set forth in 24 this act, or as much thereof as may be necessary, are hereby 25 specifically appropriated from the State Lottery Fund to the 26 several hereinafter named agencies of the Executive Department 27 of the Commonwealth for the payment of salaries, wages or other 28 compensation and travel expenses of the duly appointed officers 29 and employees of the Commonwealth, for the payment of fees for 30 contractual services rendered, for the purchase or rental of 20070H1286B1907 - 11 -
1 goods and services and for payment of any other expenses, as 2 provided by law or by this act, necessary for the proper conduct 3 of the duties, functions and activities and for the purposes 4 hereinafter set forth for the fiscal year beginning July 1, 5 2007, and for the payment of bills incurred and remaining unpaid 6 at the close of the fiscal year ending June 30, 2007. 7 (c) Energy Conservation and Assistance Fund.--The following 8 sums set forth in this act, or as much thereof as may be 9 necessary, are hereby specifically appropriated from the Energy 10 Conservation and Assistance Fund to the several hereinafter 11 named agencies of the Executive Department of the Commonwealth 12 for the payment of fees for contractual services rendered, for 13 the purchase or rental of goods and services and for the payment 14 of any other expenses, as provided by law or by this act, 15 necessary for the proper conduct of the duties, functions and 16 activities and for the purposes hereinafter set forth for the 17 fiscal year beginning July 1, 2007, and for the payment of bills 18 incurred and remaining unpaid at the close of the fiscal year 19 ending June 30, 2007. 20 (d) Judicial Computer System Augmentation Account.--The 21 following sums set forth in this act, or as much thereof as may 22 be necessary, are hereby specifically appropriated from the 23 restricted receipt account established within the General Fund, 24 known as the Judicial Computer System Augmentation Account, to 25 the Judicial Department of the Commonwealth for the payment of 26 salaries, wages or other compensation and travel expenses, for 27 the payment of fees for contractual services rendered, for the 28 purchase or rental of goods and services and for the payment of 29 any other expenses, as provided by law or by this act, necessary 30 for the proper conduct of the duties, functions and activities 20070H1286B1907 - 12 -
1 and for the purposes hereinafter set forth for the fiscal year 2 beginning July 1, 2007, and for the payment of bills incurred 3 and remaining unpaid at the close of the fiscal year ending June 4 30, 2007. 5 (e) Emergency Medical Services Operating Fund.--The 6 following sums set forth in this act, or as much thereof as may 7 be necessary, are hereby specifically appropriated from the 8 Emergency Medical Services Operating Fund to the several 9 hereinafter named agencies of the Executive Department of the 10 Commonwealth for the payment of fees for contractual services 11 rendered, for the purchase or rental of goods and services and 12 for the payment of any other expenses, as provided by law or by 13 this act, necessary for the proper conduct of the duties, 14 functions and activities and for the purposes hereinafter set 15 forth for the fiscal year beginning July 1, 2007, and for the 16 payment of bills incurred and remaining unpaid at the close of 17 the fiscal year ending June 30, 2007. 18 (f) The State Stores Fund.--The following sums set forth in 19 this act, or as much thereof as may be necessary, are hereby 20 specifically appropriated from The State Stores Fund to the 21 hereinafter named agency of the Executive Department of the 22 Commonwealth for the payment of salaries, wages or other 23 compensation and travel expenses of the duly appointed officers 24 and employees of the Commonwealth, for the payment of fees for 25 contractual services rendered, for the purchase or rental of 26 goods and services and for the payment of any other expenses, as 27 provided by law or by this act, necessary for the proper conduct 28 of the duties, functions and activities and for the purposes 29 hereinafter set forth for the fiscal year beginning July 1, 30 2007, and for the payment of bills incurred and remaining unpaid 20070H1286B1907 - 13 -
1 at the close of the fiscal year ending June 30, 2007. 2 (g) Motor License Fund.--The following sums, or as much 3 thereof as may be necessary, are hereby appropriated from the 4 Motor License Fund to the hereinafter named agencies of the 5 Executive Department for the payment of salaries, wages and 6 other compensation and travel expenses of the duly elected or 7 appointed officers and employees of the Commonwealth, for 8 contractual services and other expenses necessary for the proper 9 conduct of the duties, functions and activities for the purposes 10 hereinafter set forth for the fiscal year beginning July 1, 11 2007, and for the payment of bills incurred and remaining unpaid 12 at the close of the fiscal year ending June 30, 2007. 13 (h) Aviation Restricted Revenue Account.--The following 14 sums, or as much thereof as may be necessary, are hereby 15 appropriated from the Aviation Restricted Revenue Account in the 16 Motor License Fund to the hereinafter named agencies of the 17 Executive Department for the purposes set forth herein for the 18 fiscal year beginning July 1, 2007, and for the payment of bills 19 incurred and remaining unpaid at the close of the fiscal year 20 ending June 30, 2007. 21 (i) Hazardous Material Response Fund.--The following sums 22 set forth in this act, or as much thereof as may be necessary, 23 are hereby specifically appropriated from the Hazardous Material 24 Response Fund to the several hereinafter named agencies of the 25 Executive Department of the Commonwealth for the payment of fees 26 for contractual services rendered, for the purchase or rental of 27 goods and services and for the payment of any other expenses, as 28 provided by law or by this act, necessary for the proper conduct 29 of the duties, functions and activities and for the purposes 30 hereinafter set forth for the fiscal year beginning July 1, 20070H1286B1907 - 14 -
1 2007, and for the payment of bills incurred and remaining unpaid 2 at the close of the fiscal year ending June 30, 2007. 3 (j) Milk Marketing Fund.--The following sums set forth in 4 this act, or as much thereof as may be necessary, are hereby 5 specifically appropriated from the Milk Marketing Fund to the 6 several hereinafter named agencies of the Executive Department 7 of the Commonwealth for the payment of salaries, wages or other 8 compensation and travel expenses of the duly appointed officers 9 and employees of the Commonwealth, for the payment of fees for 10 contractual services rendered, for the purchase or rental of 11 goods and services and for the payment of any other expenses, as 12 provided by law or by this act, necessary for the proper conduct 13 of the duties, functions and activities and for the purposes 14 hereinafter set forth for the fiscal year beginning July 1, 15 2007, and for the payment of bills incurred and remaining unpaid 16 at the close of the fiscal year ending June 30, 2007. 17 (k) Home Investment Trust Fund.--The following sums set 18 forth in this act, or as much thereof as may be necessary, are 19 hereby specifically appropriated from the Home Investment Trust 20 Fund to the hereinafter named agencies of the Executive 21 Department of the Commonwealth for the payment of salaries, 22 wages or other compensation and travel expenses of the duly 23 appointed officers and employees of the Commonwealth, for the 24 payment of fees for contractual services rendered, for the 25 purchase or rental of goods and services and for the payment of 26 any other expenses, as provided by law or by this act, necessary 27 for the proper conduct of the duties, functions and activities 28 and for the purposes hereinafter set forth for the fiscal year 29 beginning July 1, 2007, and for the payment of bills incurred 30 and remaining unpaid at the close of the fiscal year ending June 20070H1286B1907 - 15 -

Block grants.--(a) Appropriation.--The 5 following sums set forth in this act, or as much thereof as may 6 be necessary, are hereby specifically appropriated from the 7 block grant (BG) funds to the several hereinafter named agencies 8 of the Executive Department of the Commonwealth for the 9 purposes, and under the restrictions, for which the funds are 10 provided for the fiscal year beginning July 1, 2007. 11 (b) Small Communities Development Block Grant.--The Small 12 Communities Development Block Grant (SCDBG) is to assist small 13 cities and communities that have a high concentration of 14 impoverished citizens and substandard housing to expand their 15 low-income and moderate-income housing opportunities and to meet 16 community development needs. 17 (c) Community Services Block Grant.--The Community Services 18 Block Grant (CSBG) is to provide a range of services and 19 activities having a measurable and potentially major impact on 20 the causes of poverty in the community or those areas of the 21 community where poverty is a particularly acute problem. In 22 addition, new focus may be placed on the unemployed, both old 23 and new. Local agencies may lower their eligibility requirements 24 for recipients to three months to allow greater flexibility to 25 assure proper consideration of each recipient. 26 (d) Preventive Health and Health Services Block Grant.--The 27 Preventive Health and Health Services Block Grant (PHHSBG) is 28 for the provision of preventive health and other health services 29 related to emergency medical systems, health initiative grants, 30 comprehensive public health, hypertension, fluoridation, health 20070H1286B1907 - 19 -
1 education, risk reduction, home health, rape crisis and domestic 2 violence services. 3 (e) Maternal and Child Health Services Block Grant.--The 4 Maternal and Child Health Services Block Grant (MCHSBG) is to 5 enable states to maintain and strengthen their leadership in 6 planning, promoting, coordinating and evaluating health care for 7 pregnant women, mothers, infants and children, and children with 8 special health care needs, and in providing health services for 9 mothers and children who do not have access to adequate health 10 care. 11 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 12 Income Home Energy Assistance Block Grant (LIHEABG) is to help 13 lessen the impact of the high cost of energy on low-income 14 families and individuals, including energy efficiency grants for 15 low-income dwellings. No less than 15% of the LIHEABG funds 16 received shall be used for weatherization. LIHEABG funds 17 received pursuant to a Presidential release of contingency funds 18 shall be exempt from the 15% requirement. 19 (g) Social Services Block Grant.--The Social Services Block 20 Grant (SSBG) is for the provision of social services to eligible 21 persons. 22 (h) Mental Health Services Block Grant.--The Mental Health 23 Services Block Grant (MHSBG) provides funds for the provision of 24 services to adults with serious mental illness or children with 25 serious emotional disturbance. 26 (i) Substance Abuse Block Grant.--The Substance Abuse Block 27 Grant (SABG) provides funds to establish and maintain programs 28 to combat alcohol and drug abuse. 29 (j) Child Care and Development Fund Block Grant.--The Child 30 Care and Development Fund Block Grant (CCDFBG) is for the 20070H1286B1907 - 20 -

Compliance with other law before funds 8 available.--No appropriation made by this part to any 9 department, board, commission or agency of the Executive 10 Department shall be available unless and until the department, 11 board, commission or agency has complied with sections 615 and 12 616 of the act of April 9, 1929 (P.L.177, No.175), known as The 13 Administrative Code of 1929. 14 Section 1793. Contracts prerequisite to encumbering or 15 committing funds.--Funds for the purchase of supplies, materials 16 and equipment shall not be deemed to be committed or encumbered 17 until contracts covering the purchase have been entered into 18 with the vendors. 19 Section 1794. Minority business set-asides.--(a) Each 20 department or other instrumentality of the Commonwealth listed 21 in Subpart B authorized to contract for buildings, highways, 22 commodities, equipment, supplies or services shall report to the 23 General Assembly all information pertinent to anticipated 24 procurement needs at the beginning of each fiscal year and each 25 fiscal quarter thereafter. 26 (b) As used in this section, the term "minority business" 27 means a minority business enterprise as defined in the act of 28 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 29 Minority Business Development Authority Act. 30 Section 1795. 1 sources.--(a) In addition to the amounts appropriated by this 2 part, moneys received in payment for food and household supplies 3 furnished to employees and other persons, except inmates, by an 4 institution, and moneys received from the proceeds from the sale 5 of any products of the soil, meats, livestock, timber or other 6 materials sold by the department shall be paid into the General 7 Fund and are hereby appropriated out of the General Fund to the 8 several respective institutions for the operation and 9 maintenance of the institutions. 10 (b) In addition to the amounts appropriated by this part, 11 all moneys received from any other source, except the Federal 12 Government, as contributions for the programs provided herein or 13 as payment for services or materials furnished by one 14 institution to another, except those collections designated as 15 revenues, shall be paid into the General Fund and are hereby 16 appropriated out of the General Fund for the purposes of the 17 respective appropriations. 18 (c) In addition to any funds specifically appropriated by 19 this part, all moneys received by a department or agency of the 20 Commonwealth from any other sources, except the Federal 21 Government, as contributions or supplements to the department or 22 agency for a program or administration of an act included in 23 this part shall be paid into the General Fund and credited to 24 the appropriation for that program or administration of the act. 25 Section 1796. Lapsing of unused funds.--(a) Except as 26 otherwise provided by law or by this section, that part of all 27 appropriations in Part XVIII unexpended, uncommitted or 28 unencumbered as of June 30, 2007, shall automatically lapse as 29 of that date. 30 (b) The appropriations in section 1723 to the Pennsylvania 20070H1286B1907 - 192 -
1 Emergency Management Agency for April 2005 storm disaster - 2 public assistance shall be a continuing appropriation until June 3 30, 2007. 4 Section 1797. Construction with prior appropriation acts.-- 5 Any appropriation in Subparts B, C, D and E of this part which 6 is the same or similar to any appropriation in the act of July 7 2, 2006 (P.L. , No.2A), known as the General Appropriation 8 Act of 2006, or the act of July 2, 2006 (P.L. , No.6A) 9 entitled, "An act making an appropriation from a restricted 10 revenue account within the General Fund and from Federal 11 augmentation funds to the Pennsylvania Public Utility 12 Commission," shall replace that appropriation. 13 Section 1798. Deduction of expended appropriations under 14 prior law.--Any money which has been appropriated and expended 15 under the act of July 2, 2006 (P.L. , No.2A), known as the 16 General Appropriation Act of 2006, or the act of July 2, 2006 17 (P.L. , No.6A) entitled, "An act making an appropriation 18 from a restricted revenue account within the General Fund and 19 from Federal augmentation funds to the Pennsylvania Public 20 Utility Commission," shall be deducted from the corresponding 21 appropriation in this part. 22 PART XVIII 23 SPECIAL PROVISIONS FOR FEDERAL FUNDS 24 FOR 2007-2008 25 Section 1801. General Fund repository for Federal funds.-- 26 All moneys received from the Federal Government as contributions 27 or supplements to the departments or agencies of the 28 Commonwealth or the programs herein provided shall be paid into 29 the General Fund. 30 Section 1802. Limitation on encumbering or spending Federal 20070H1286B1907 - 193 -
1 funds.--Federal funds shall be encumbered or spent only to the 2 extent that such funds are estimated as being available during 3 the fiscal year of the Commonwealth. 4 Section 1803. Appropriation of prior unspent Federal 5 funds.--(a) Any Federal money which has been previously 6 appropriated by the General Assembly and authorized or allocated 7 by the Federal Government but remains unspent from prior fiscal 8 years and will not be renewed for fiscal year 2007-2008 is 9 hereby appropriated. 10 (b) The Federal appropriations to the Department of Public 11 Welfare include any prior earnings that may be received during 12 fiscal year 2007-2008. In addition to the amounts specifically 13 appropriated herein to the Department of Public Welfare, all 14 moneys appropriated from the Federal Government during any 15 previous fiscal year which are expected to be received as 16 reimbursements may be carried forward until June 30, 2008, to 17 the extent that obligations are carried forward. In addition, 18 any reimbursements actually received to support such obligations 19 may also be carried forward. 20 Section 1804. Subgrants between Federal fund 21 appropriations.--Subgrants may be made between appropriations 22 without further approval of the General Assembly. The Secretary 23 of the Budget shall submit a list of subgrants to the chairman 24 and minority chairman of the Appropriations Committee of the 25 Senate and the chairman and minority chairman of the 26 Appropriations Committee of the House of Representatives 27 quarterly. No subgrant to a State agency, however, may be made 28 from a restricted receipt account without a specific 29 appropriation by the General Assembly. 30 Section 1805. Utilization of emergency Federal funds.--(a) 20070H1286B1907 - 194 -
1 Federal funds available for costs and damages resulting from 2 natural disasters or civil disobedience may be added to an 3 appropriation contained in this act or to funds appropriated or 4 may be used for the purposes prescribed by the Federal 5 Government. 6 (b) In addition to the moneys appropriated by this act, all 7 moneys received from the Federal Government for the purpose of 8 disaster assistance or relief, or other moneys received as a 9 direct result of terrorist acts, moneys for homeland security 10 and defense and moneys for avian flu/pandemic preparedness shall 11 be paid into the General Fund and are hereby appropriated out of 12 the General Fund to the departments, boards, commissions or 13 agencies designated by the Governor. 14 (c) In the event of any emergency situation in which the 15 General Assembly cannot act in sufficient time, the Governor is 16 authorized through executive authorization to provide up to 17 $10,000,000 in Federal funds to alleviate the emergency 18 situation. For the purposes of this section, "emergency" is 19 defined as any situation in which there is a chance of or which 20 may result in substantial human suffering. 21 Section 1806. Transfer of funds from TANFBG to CCDFBG and 22 SSBG.--In accordance with Federal law which permits the transfer 23 of funds from the TANFBG to the CCDFBG and SSBG, the Department 24 of Public Welfare, upon approval of the Secretary of the Budget, 25 may make such transfers of funds provided that any such transfer 26 will not result in a deficit in any appropriation from which 27 funds are transferred. The Secretary of the Budget shall provide 28 ten days prior notification of any such transfers to the 29 chairman and the minority chairman of the Appropriations 30 Committee of the Senate and the chairman and minority chairman 20070H1286B1907 - 195 -
1 of the Appropriations Committee of the House of Representatives. 2 PART XIX 3 MISCELLANEOUS PROVISIONS FOR 2007-2008 4 Section 1901. Prior laws unaffected.--Except as provided in 5 section 253, this act is not intended to be inconsistent with or 6 to repeal any provision of any act enacted at this or any prior 7 session of the General Assembly regulating the purchase of 8 supplies, the ordering of printing and binding, the purchase, 9 maintenance and use of automobiles, the method of making 10 payments from the State Treasury for any purpose or the 11 functioning of any administrative department, board or 12 commission. 13 Section 1902. Compliance with other law before funds 14 available.--No appropriation made by this act to any department, 15 board, commission or agency of the Executive Department shall be 16 available unless and until the department, board, commission or 17 agency has complied with sections 615 and 616 of the act of 18 April 9, 1929 (P.L.177, No.175), known as The Administrative 19 Code of 1929. 20 Section 1903. Contracts prerequisite to encumbering or 21 committing funds.--Funds available to agencies, boards, 22 departments, commissions, or other governmental entities under 23 this act for the procurement of supplies, services or 24 construction shall not be available for payment of, or to be 25 committed to or encumbered for payment of, any such procurement 26 unless and until the agency, board, department or other 27 governmental entity has complied with all of the requirements 28 applicable to the procurement that are set out in 62 Pa.C.S. 29 (relating to procurement) and in the policies, procedures and 30 regulations instituted in accordance with that code. 20070H1286B1907 - 196 -

Lapsing of unused funds.--(a) Except as 8 otherwise provided by law or by this section, that part of all 9 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 10 XI, XII, XIII, XIV, XV and XVI unexpended, uncommitted or 11 unencumbered as of June 30, 2008, shall automatically lapse as 12 of that date. 13 (b) The appropriation in Part II to the Department of 14 Community and Economic Development for family savings accounts 15 shall be a continuing appropriation. 16 (c) The appropriation in Part II to the Pennsylvania 17 Emergency Management Agency for June 2006 Flood Disaster Relief 18 shall be a continuing appropriation. 19 (d) The appropriations in Part II to the Legislative 20 Department shall be continuing appropriations. 21 (e) The appropriations in Part II to the Supreme Court for 22 the unified judicial security programs shall be a continuing 23 appropriation. 24 (f) The appropriation in Part II for county court 25 reimbursements for the gun courts shall be a continuing 26 appropriation until June 30, 2009. 27 Section 1907. Appellate courts appropriation contingency.-- 28 The funds appropriated in Part II to the Supreme, Superior and 29 Commonwealth Courts for justice and judge expenses are 30 contingent upon a vouchered expense account plan being continued 20070H1286B1907 - 198 -
1 by the Supreme Court. 2 Section 1908. Transfer of excess funds.--The Governor may 3 transfer any excess money in those funds receiving proceeds of 4 Commonwealth of Pennsylvania general obligation bonds in excess 5 of the amount necessary for the purposes for which the bonds 6 were issued to the appropriate sinking fund for payment of debt 7 service due on outstanding bonds. If such excess funds, together 8 with any available balance, exceed the amount of debt service 9 remaining to be paid, the funds shall be transferred to the 10 General Fund or to the appropriate special fund responsible for 11 such debt service. 12 PART XX 13 EFFECTIVE DATE 14 Section 2001. Retroactivity.--This act shall be retroactive 15 as follows: 16 (1) The provisions of Part XVIII of this act shall be 17 retroactive to June 30, 2007. 18 (2) Except as provided in paragraph (1), the remainder 19 of this act shall be retroactive to July 1, 2007. 20 Section 2002. Effective date.--This act shall take effect as 21 follows: 22 (1) The following provisions shall take effect 23 immediately: 24 (i) Section 2101. 25 (ii) This section. 26 (2) The remainder of this act shall take effect July 1, 27 2007, or immediately, whichever is later.
