           REPRESENTATIVES, AS AMENDED, JUNE 13, 2007

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for transfer of
     6     records.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1305-A of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949, added
    11  June 30, 1995 (P.L.220, No.26), is amended to read:
    12     Section 1305-A.  Transfer of Records.--Whenever a pupil
    13  transfers to another school entity or nonpublic school, a
    14  certified copy of the student's disciplinary record shall be
    15  transmitted to the school entity or nonpublic school to which
    16  the pupil has transferred. The school entity or nonpublic school
    17  to which the student has transferred should request the record.
    18  The sending school entity or nonpublic school shall have ten
    19  (10) days from receipt of the request to supply a certified copy


     1  of the student's disciplinary record. The requirements of this
     2  section apply as well to transfers between schools within the
     3  same school entity.
     4     SECTION 2.  SECTION 1729-A(J) OF THE ACT, ADDED JUNE 19, 1997  <--
     5  (P.L.225, NO.22), IS AMENDED TO READ:
     6     SECTION 1729-A.  CAUSES FOR NONRENEWAL OR TERMINATION.--* * *
     7     (J)  WHEN A CHARTER IS REVOKED OR IS NOT RENEWED, A STUDENT
     8  WHO ATTENDED THE CHARTER SCHOOL SHALL APPLY TO ANOTHER PUBLIC
     9  SCHOOL IN THE STUDENT'S SCHOOL DISTRICT OF RESIDENCE. NORMAL
    10  APPLICATION DEADLINES WILL BE DISREGARDED UNDER THESE
    11  CIRCUMSTANCES. ALL STUDENT RECORDS MAINTAINED BY THE CHARTER
    12  SCHOOL SHALL BE FORWARDED TO THE STUDENT'S DISTRICT OF
    13  RESIDENCE[.] WITHIN TEN (10) DAYS OF THE REVOCATION OR
    14  NONRENEWAL OF THE CHARTER.
    15     Section 2 3.  This act shall take effect in 60 days.           <--
