AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further prohibiting use of hearing impairment
3 devices.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 3314(b) of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 3314. Prohibiting use of hearing impairment devices.

10 (b) [Exception] Exceptions.--This section does not prohibit:
11 [the]
12 (1) The use of hearing aids or other devices for
13 improving the hearing of the driver.[, nor does it prohibit
14 the]
15 (2) The use of a headset in conjunction with a cellular
16 telephone that only provides sound through one ear and allows
17 surrounding sounds to be heard with the other ear[,].
18 Cellular telephone use is allowed only on highways having a
1 speed limit of no more than 25 miles per hour.
2 (3) The [nor does it prohibit the] use of communication
3 equipment by the driver of an emergency vehicle [or by].
4 (4) The use of communication equipment by motorcycle
5 operators complying with section 3525 (relating to protective
6 equipment for motorcycle riders). Use of a cellular telephone
7 is allowed only on highways having a speed limit of no more
8 than 25 miles per hour.
9 Section 2. This act shall take effect in 60 days.
