                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for corrupt
     3     organizations; and providing for deception relating to
     4     documents showing citizenship or resident status.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 911(h)(1)(i) of Title 18 of the
     8  Pennsylvania Consolidated Statutes, amended November 1, 2006
     9  (P.L.1243, No.135), November 9, 2006 (P.L.1340, No.139) and
    10  November 29, 2006 (P.L.1481, No.168), is amended to read:
    11  § 911.  Corrupt organizations.

    13     (h)  Definitions.--As used in this section:
    14         (1)  "Racketeering activity" means all of the following:
    15             (i)  An act which is indictable under any of the


     1         following provisions of this title:
     2                 Chapter 25 (relating to criminal homicide)
     3                 Section 2706 (relating to terroristic threats)
     4                 Chapter 29 (relating to kidnapping)
     5                 Chapter 30 (relating to trafficking of persons)
     6                 Chapter 33 (relating to arson, criminal mischief
     7             and other property destruction)
     8                 Chapter 37 (relating to robbery)
     9                 Chapter 39 (relating to theft and related
    10             offenses)
    11                 Section 4108 (relating to commercial bribery and
    12             breach of duty to act disinterestedly)
    13                 Section 4109 (relating to rigging publicly
    14             exhibited contest)
    15                 Section 4117 (relating to insurance fraud)
    16                 Section 4121 (relating to deception relating to
    17             documents showing citizenship or resident status)
    18                 Chapter 47 (relating to bribery and corrupt
    19             influence)
    20                 Chapter 49 (relating to falsification and
    21             intimidation)
    22                 Section 5111 (relating to dealing in proceeds of
    23             unlawful activities)
    24                 Section 5512 (relating to lotteries, etc.)
    25                 Section 5513 (relating to gambling devices,
    26             gambling, etc.)
    27                 Section 5514 (relating to pool selling and
    28             bookmaking)
    29                 Chapter 59 (relating to public indecency).

     1     Section 2.  Title 18 is amended by adding a section to read:
     2  § 4121.  Deception relating to documents showing citizenship or
     3             resident status.
     4     A person commits a misdemeanor of the first degree if, with
     5  the intent to deceive an employer, the person produces or
     6  supplies another person with any false documents that create the
     7  appearance that a potential employee of the employer is a
     8  citizen of the United States or is legally residing in the
     9  United States or its territories.
    10     Section 3.  This act shall take effect in 60 days.
