                                     AN ACT

     1  Amending the act of November 10, 1999 (P.L.491, No.45), entitled
     2     "An act establishing a uniform construction code; imposing
     3     powers and duties on municipalities and the Department of
     4     Labor and Industry; providing for enforcement; imposing
     5     penalties; and making repeals," further providing for
     6     applicability of act to swimming pools and spas.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 104(f) of the act of November 10, 1999
    10  (P.L.491, No.45), known as the Pennsylvania Construction Code
    11  Act, is amended to read:
    12  Section 104.  Application.
    13     * * *
    14     (f)  Application to swimming pools and spas.--
    15         (1)  The provisions of this act as they relate to
    16     swimming pools and spas shall not be applicable to those
    17     constructed or installed prior to the effective date of this
    18     act.


     1         (2)  All swimming pools and spas constructed or installed
     2     after the effective date of this act shall be governed by the
     3     requirements of this act, including section 503.
     4         (3)  A swimming pool or spa subject to paragraph (2) may
     5     not be filled with water until the barrier requirements of
     6     this act are met and during construction of a swimming pool,
     7     temporary barriers shall be erected as required by department
     8     regulations.
     9     Section 2.  This act shall take effect in 60 days.
