AN ACT 1 Authorizing the Department of General Services, with the 2 approval of the Department of Military and Veterans' Affairs 3 and the Governor, to grant and convey, at a price to be 4 determined through a competitive bid process, certain lands, 5 buildings and improvements situate in the Borough of 6 Ligonier, Westmoreland County. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. The Department of General Services, with the 10 approval of the Department of Military and Veterans' Affairs and 11 the Governor, is hereby authorized on behalf of the Commonwealth 12 of Pennsylvania to grant and convey the following tract of land 13 together with any buildings, structures or improvements thereon, 14 situate in the Borough of Ligonier, Westmoreland County, 15 Pennsylvania. The Department of General Services shall sell the 16 property using, in its discretion, one of the following methods 17 of sale: an invitation for sealed bids or public auction. 18 Section 2. The property to be conveyed pursuant to Section 1 19 consists of approximately 2.86-acres and a building bounded and
1 more particularly described as follows: 2 ALL THAT CERTAIN tract of land situate in the Borough of 3 Ligonier, Westmoreland County more particularly bounded and 4 described as follows: 5 BEGINNING at a point in the center line of the Lincoln 6 Highway, where the same intersects with the Southeasterly line 7 of Walnut Street projected; thence North 46 degrees 13 minutes 8 East 39 feet to the right-of-way line of the said Lincoln 9 Highway; thence, continuing along the Southeasterly line of 10 Walnut Street, North 46 degrees 13 minutes East 743.2 feet to a 11 point on the Southwesterly side of a twenty (20) foot alley; 12 thence along same and other lands N/F Ligonier Valley Rail Road 13 Company, South 43 degrees 47 minutes East 190 feet to a point; 14 thence along other lands N/F Ligonier Valley Rail Road Company, 15 South 46 degrees 13 minutes West 493.1 feet to a point; thence 16 along same, South 69 degrees 3 minutes West 119.3 feet to a 17 point; thence along same, South 77 degrees 14 minutes West 163.6 18 feet to a point on the right-of-way line of the Lincoln Highway; 19 thence South 77 degrees 14 minutes West 46.5 feet to a point in 20 the center line of the Lincoln Highway; thence along the center 21 line of said Lincoln Highway, North 43 degrees 30 minutes West 22 35.6 feet to a point, the place of BEGINNING. 23 CONTAINING 2.86-acres more or less. 24 BEING the same property conveyed to the Commonwealth of 25 Pennsylvania by the Ligonier Valley Rail Road Company in its 26 deed, dated July 15, 1937, recorded in the Westmoreland County 27 Recorder of Deeds Office in Deed Book Volume 1004, Page 467. 28 Section 3. The conveyance shall be made under and subject to 29 all lawful and enforceable easements, servitudes and rights of 30 others, including but not confined to streets, roadways and 20070H0794B0913 - 2 -
1 rights of any telephone, telegraph, water, electric, gas or 2 pipeline companies, as well as under and subject to any lawful 3 and enforceable estates or tenancies vested in third persons 4 appearing of record, for any portion of the land or improvements 5 erected thereon. 6 Section 4. The deed of conveyance shall be by Special 7 Warranty Deed and shall be executed by the Secretary of General 8 Services in the name of the Commonwealth of Pennsylvania. 9 Section 5. The proceeds from the sale shall be deposited in 10 the State Treasury Armory Fund. 11 Section 6. This act shall take effect immediately. C8L85JS/20070H0794B0913 - 3 -
