AN ACT 1 Amending the act of August 9, 1955 (P.L.323, No.130), entitled, 2 as amended, "An act relating to counties of the first, third, 3 fourth, fifth, sixth, seventh and eighth classes; amending, 4 revising, consolidating and changing the laws relating 5 thereto; relating to imposition of excise taxes by counties, 6 including authorizing imposition of an excise tax on the 7 rental of motor vehicles by counties of the first class; and 8 providing for regional renaissance initiatives," providing 9 for county police in counties of the third class. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Article XIV heading of the act of August 9, 1955 13 (P.L.323, No.130), known as The County Code, is amended and the 14 article is amended by adding a subarticle to read: 15 ARTICLE XIV 16 DISTRICT ATTORNEY, ASSISTANTS 17 [AND], DETECTIVES AND COUNTY POLICE 18 * * * 19 (d) County Police 20 Section 1461. Employment of Police.--(a) The county 21 commissioners in any county of the third class shall have power
1 to employ such number of police as may be fixed by the salary 2 board of the county. The compensation of the police officers 3 shall be paid by the county. 4 (b) The police officers shall have jurisdiction anywhere 5 within the county by which employed, and shall have and possess 6 all the following powers: 7 (1) To make arrests, without warrant, for all violations of 8 the law which they may witness, and to serve and execute 9 warrants issued by the proper authorities. In cases of offenses 10 for violation of any of the provisions of 75 Pa.C.S. (relating 11 to vehicles), the power to make arrests without warrant shall be 12 limited to cases where the offense is designated a felony or a 13 misdemeanor, and cases causing or contributing to an accident 14 resulting in injury or death to any person. 15 (2) The powers and prerogatives conferred by the law upon 16 members of the police force of cities of the first class. 17 (3) The powers and prerogatives conferred by law on 18 constables of the Commonwealth. 19 (4) To serve subpoenas issued for any examination, 20 investigation or trial conducted pursuant to any law of this 21 Commonwealth. 22 Section 2.
