AN ACT 1 Amending Title 66 (Public Utilities) of the Pennsylvania 2 Consolidated Statutes, further providing for duties of 3 electric distribution companies. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 2807(e)(3) of Title 66 of the 7 Pennsylvania Consolidated Statutes is amended to read: 8 § 2807. Duties of electric distribution companies. 9 * * * 10 (e) Obligation to serve.--An electric distribution company's 11 obligation to provide electric service following implementation 12 of restructuring and the choice of alternative generation by a 13 customer is revised as follows: 14 * * * 15 (3) (i) If [a customer contracts] customers contract 16 for electric energy and it is not delivered or if [a 17 customer does] customers do not choose an alternative
1 electric generation supplier, the electric distribution 2 company or commission-approved alternative supplier shall 3 acquire [electric energy at prevailing market prices] a 4 portfolio of resources through one or more competitive 5 procurement processes approved by the commission to serve 6 [that customer] those customers and shall recover fully 7 all reasonable costs. 8 (ii) In addition to complying with the requirements 9 of the act of November 30, 2004 (P.L.1672, No.213), known 10 as the Alternative Energy Portfolio Standards Act, the 11 resource portfolio acquired pursuant to this paragraph 12 shall be designed to produce the lowest reasonable rates 13 on a long-term stable basis and shall reflect a diversity 14 of supply-side and demand-side resources, a diversity of 15 fuel types and an appropriate mix of long-term, short- 16 term and spot market purchases. 17 * * * 18 Section 2.
