        AS AMENDED ON SECOND CONSIDERATION, HOUSE OF REPRESENTATIVES,
           APRIL 17, 2007

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for the offense of illegal
     3     dumping of methamphetamine waste; and imposing a penalty.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3313.  Illegal dumping of methamphetamine waste.
     9     (a)  Offense defined.--A person commits a felony of the third
    10  degree if he knowingly deposits on any property a precursor
    11  substance, chemical waste or debris, used in or resulting from    <--
    12  THAT HAS BEEN OR IS INTENDED TO BE USED IN the manufacture of     <--
    13  methamphetamine or the preparation of a precursor substance for
    14  the manufacture of methamphetamine.


     1     (b)  Exceptions.--Subsection (a) does not apply to the
     2  disposal of waste products:
     3         (1)  by a licensed pharmaceutical company in the normal
     4     course of business; or
     5         (2)  pursuant to Federal or State laws regulating the
     6     cleanup or disposal of waste products from unlawful
     7     manufacturing of methamphetamine.
     8     Section 2.  This act shall take effect in 60 days.
