                                     AN ACT

     1  Amending the act of July 31, 1968 (P.L.769, No.240), entitled
     2     "An act relating to Commonwealth documents; providing for the
     3     printing and distribution of administrative regulations;
     4     regulating the adoption, publication, codification and
     5     effectiveness of regulations, statements of policy, and
     6     certain other Commonwealth documents; creating the Joint
     7     Committee on Documents and prescribing its powers and duties;
     8     providing penalties, and making appropriations and repeals,"
     9     further defining "administrative regulation" in relation to
    10     the Department of Environmental Protection.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 102(2) of the act of July 31, 1968
    14  (P.L.769, No.240), referred to as the Commonwealth Documents
    15  Law, is amended to read:
    16     Section 102.  Definitions.--The following words and terms
    17  shall have the following meanings, unless the context clearly
    18  indicates otherwise:

     1     (2)  "Administrative regulation" means any regulation except
     2  a proclamation, executive order, executive directive or other
     3  similar document promulgated by the Governor, and the term
     4  includes a regulation which may be promulgated by an agency only
     5  with the approval of the Governor. In relation to the Department
     6  of Environmental Protection only, the term shall include any new
     7  or modification to a regulation, manual, procedural manual,
     8  guideline, enforcement guideline, policy, strategy document,
     9  policy guidance manual or technical guidance manual or
    10  administrative opinion or legal opinion regarding the
    11  interpretation of a statute, court order or regulation used by
    12  the Department of Environmental Protection to implement a
    13  regulatory enforcement process.

    15     Section 2.  This act shall take effect immediately.
