A JOINT RESOLUTION
1 Proposing integrated amendments to the Constitution of the
2 Commonwealth of Pennsylvania, providing for refusal of
3 compensation of public officers.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby resolves as follows:
6 Section 1. The following integrated amendments to the
7 Constitution of Pennsylvania are proposed in accordance with
8 Article XI:
9 (1) That section 8 of Article II be amended to read:
10 § 8. Compensation.
11 The members of the General Assembly shall receive such salary
12 and mileage for regular and special sessions as shall be fixed
13 by law, and no other compensation whatever, whether for service
14 upon committee or otherwise. No member of either House shall
15 during the term for which he may have been elected, receive any
16 increase of salary, or mileage, under any law passed during such
17 term. A member of either House may decline to accept an increase
1 in salary and mileage. 2 (2) That Article IV be amended by adding a section to read: 3 § 1.1. Compensation. 4 A public officer in the executive branch may decline to 5 accept an increase in salary and mileage. 6 (3) That section 16(a) of Article V be amended to read: 7 § 16. Compensation and retirement of justices, judges and 8 justices of the peace. 9 (a) Justices, judges and justices of the peace shall be 10 compensated by the Commonwealth as provided by law. Their 11 compensation shall not be diminished during their terms of 12 office, unless by law applying generally to all salaried 13 officers of the Commonwealth. A justice, judge or justice of the 14 peace may decline to accept an increase in compensation. 15 * * * 16 Section 2. (a) Upon the first passage by the General 17 Assembly of these proposed constitutional amendments, the 18 Secretary of the Commonwealth shall proceed immediately to 19 comply with the advertising requirements of section 1 of Article 20 XI of the Constitution of Pennsylvania and shall transmit the 21 required advertisements to two newspapers in every county in 22 which such newspapers are published in sufficient time after 23 passage of these proposed constitutional amendments. 24 (b) Upon the second passage by the General Assembly of these 25 proposed constitutional amendments, the Secretary of the 26 Commonwealth shall proceed immediately to comply with the 27 advertising requirements of section 1 of Article XI of the 28 Constitution of Pennsylvania and shall transmit the required 29 advertisements to two newspapers in every county in which such 30 newspapers are published in sufficient time after passage of 20070H0671B0758 - 2 -

The Secretary of the 2 Commonwealth shall submit the proposed constitutional amendments 3 under section 1 to the qualified electors of this Commonwealth 4 as a single ballot question at the first primary, general or 5 municipal election which meets the requirements of and is in 6 conformance with section 1 of Article XI of the Constitution of 7 Pennsylvania and which occurs at least three months after the 8 proposed constitutional amendments are passed by the General 9 Assembly.
