                                     AN ACT

     1  Providing for a public health access program beneficiary
     2     employer report; and imposing duties on the Secretary of
     3     Health.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Definitions.
     7     The following words and phrases when used in this act shall
     8  have the meanings given to them in this section unless the
     9  context clearly indicates otherwise:
    10     "Public health access program beneficiary."  A person who
    11  receives medical assistance or medical benefits or a person who
    12  receives health care services that qualify as free care.
    13  Section 2.  Public health access program beneficiary employer
    14                 report.
    15     Notwithstanding any law to the contrary, the Secretary of
    16  Health shall annually prepare a public health access program


     1  beneficiary employer report.
     2  Section 3.  Report information.
     3     (a)  General rule.--The report shall provide the following
     4  information for each employer of 50 or more public health access
     5  beneficiaries:
     6         (1)  The name and address of the employer.
     7         (2)  The number of public health access program
     8     beneficiaries who are employees of the employer.
     9         (3)  The number of public health access program
    10     beneficiaries who are spouses or dependents of employees of
    11     the employer.
    12         (4)  Whether the employer offers health benefits to its
    13     employees.
    14         (5)  The cost to the Commonwealth of providing public
    15     health access program benefits for their employees and
    16     enrolled dependents.
    17     (b)  Exceptions.--The report shall not include the names of
    18  any individual public health access program beneficiaries and
    19  shall be subject to privacy standards.
    20  Section 4.  Annual report.
    21     The report shall be submitted annually on February 1 to the
    22  President pro tempore of the Senate, the Speaker of the House of
    23  Representatives and the chair of the Public Health and Welfare
    24  Committee of the Senate and the chair of the Health and Human
    25  Services Committee of the House of Representatives.
    26  Section 5.  Effective date.
    27     This act shall take effect in 60 days.
