                                     AN ACT

     1  Amending the act of December 20, 1985 (P.L.457, No.112),
     2     entitled "An act relating to the right to practice medicine
     3     and surgery and the right to practice medically related acts;
     4     reestablishing the State Board of Medical Education and
     5     Licensure as the State Board of Medicine and providing for
     6     its composition, powers and duties; providing for the
     7     issuance of licenses and certificates and the suspension and
     8     revocation of licenses and certificates; providing penalties;
     9     and making repeals," providing for waiver of biennial
    10     registration fee.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 25 of the act of December 20, 1985
    14  (P.L.457, No.112), known as the Medical Practice Act of 1985, is
    15  amended to read:
    16  Section 25.  Licenses and certificates; biennial registration.
    17     (a)  Issuance of licenses and certificates.--All applicants
    18  who have complied with the requirements of the board and who
    19  have passed a final examination and who have otherwise complied
    20  with the provisions of this act shall receive from the
    21  commissioner, or whoever exercises equivalent authority acting

     1  for the board, a license or certificate entitling them to the
     2  right to practice in this Commonwealth. Each such license or
     3  certificate shall be duly recorded in the office of the board,
     4  in a record to be properly kept for that purpose which shall be
     5  open to public inspection, and a certified copy of said record
     6  shall be received as evidence in all courts in this Commonwealth
     7  in the trial of any case.
     8     (b)  Renewals.--It shall be the duty of all persons now or
     9  hereafter licensed or certified to be registered with the board
    10  and, thereafter, to register in like manner at such intervals
    11  and by such methods as the board shall determine by regulations,
    12  but in no case shall such renewal period be longer than two
    13  years. The form and method of such registration shall be
    14  determined by the board.
    15     (c)  Fees.--[Each person] Subject to subsection (c.1), an
    16  individual so registering with the board shall pay, for each
    17  biennial registration, a reasonable fee which, if any, shall
    18  accompany the application for such registration.
    19     (c.1)  Waiver.--The board may waive the fee for biennial
    20  registration in cases where an individual presents evidence that
    21  payment of the fee will cause undue economic hardship. The
    22  request for waiver shall be made in writing. The board shall
    23  respond to the request for waiver via registered mail and shall
    24  set forth its reasons for acceptance or denial of the request.
    25     (d)  Evidence of registration.--Upon receiving a proper
    26  application for such registration accompanied by the fee, if
    27  any, above provided for, the board shall issue a certificate of
    28  registration to the applicant. Said certificate together with
    29  its renewals shall be good and sufficient evidence of
    30  registration under the provisions of this act.
