                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, defining "biometrics," "fingerprint imaging" and
     3     "smart card technology"; and further providing for issuance
     4     and content of driver's license and for commercial driver's
     5     license.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 102 of Title 75 of the Pennsylvania
     9  Consolidated Statutes is amended by adding definitions to read:
    10  § 102.  Definitions.
    11     Subject to additional definitions contained in subsequent
    12  provisions of this title which are applicable to specific
    13  provisions of this title, the following words and phrases when
    14  used in this title shall have, unless the context clearly
    15  indicates otherwise, the meanings given to them in this section:
    16     * * *
    17     "Biometrics."  The science and technology for measuring and
    18  analyzing human body characteristics, including, but not limited
    19  to, fingerprints, eye retinas and irises, voice patterns, facial

     1  patterns or hand measurements for the purpose of personal
     2  identity authentication.

     4     "Fingerprint imaging."  A biometric process by which
     5  fingerprints are scanned, identifying features (minutiae) are
     6  extracted and measurements of the minutiae points relative to
     7  each other are mapped for comparison.
     8     * * *
     9     "Smart card technology."  A small electronic device that
    10  contains electronic memory on an embedded integrated circuit.
    11     * * *
    12     Section 2.  Section 1510(a) and (b) of Title 75, amended
    13  November 29, 2006 (P.L.1449, No.159), are amended and the
    14  section is amended by adding subsections to read:
    15  § 1510.  Issuance and content of driver's license.
    16     (a)  General rule.--The department shall, upon payment of the
    17  required fee, issue to every qualified applicant a driver's
    18  license [indicating the type or general class of vehicles the
    19  licensee is authorized to drive and any endorsements or
    20  restrictions, which license shall contain a distinguishing
    21  number assigned by the department to the licensee, the actual
    22  name, date of birth, residence address, a color photograph or
    23  photographic facsimile of the licensee, such other information
    24  as may be required by the department, and either a facsimile of
    25  the signature of the licensee or a space upon which the licensee
    26  shall write his usual signature with pen and ink.] which
    27  complies with the requirements of subsections (a.1), (a.2) and
    28  this subsection. The driver's license shall be designed and
    29  manufactured utilizing smart card technology which utilizes a
    30  departmental managed smart card technology database to retrieve

     1  the pertinent information under subsections (a.1) and (a.2).
     2  Program participants in the Address Confidentiality Program
     3  under 23 Pa.C.S. Ch. 67 (relating to domestic and sexual
     4  violence victim address confidentiality) may use a substitute
     5  address designated by the Office of Victim Advocate as their
     6  address. Personal medical data and other information for use in
     7  an emergency may be included as a part of the license.
     8  Information other than that required to identify the licensee,
     9  the distinguishing number and the class of license issued may be
    10  included in microdata form. Except as provided in subsection
    11  (f), an applicant shall include his Social Security number on
    12  his license application, but the Social Security number shall
    13  not be included on the license. No driver's license shall be
    14  valid until it has been signed by the licensee.
    15     (a.1)  Visual information on license.--A driver's license
    16  issued under subsection (a) shall contain in visual format all
    17  of the following:
    18         (1)  A distinguishing number assigned by the department
    19     to the licensee.
    20         (2)  A color photograph or photographic facsimile of the
    21     licensee.
    22         (3)  The actual name of the licensee in printed form.
    23         (4)  A facsimile of the signature of the licensee.
    24         (5)  The expiration date of the license.
    25         (6)  Any other information the department deems
    26     necessary.
    27     (a.2)  Information stored by smart card technology.--The
    28  smart card technology required under this section shall be
    29  capable of storing in a secure manner all of the following
    30  information:

     1         (1)  A distinguishing number assigned by the department
     2     to the licensee.
     3         (2)  The actual name of the licensee.
     4         (3)  The date of birth of the licensee.
     5         (4)  The residential address of the licensee.
     6         (5)  A physical description of the person, including sex,
     7     height and eye color.
     8         (6)  A facsimile of the signature of the licensee.
     9         (7)  Social Security number.
    10         (8)  Fingerprint image.
    11         (9)  The type or general class of vehicles the licensee
    12     is authorized to drive.
    13         (10)  Any restrictions or endorsements.
    14         (11)  The expiration date of the license.
    15         (12)  Any other information the department deems
    16     necessary.
    17     (b)  Identification card.--The department shall, upon payment
    18  of the required fee, issue an identification card to any person
    19  ten years of age or older who has made application therefor in
    20  such manner as the department shall prescribe or whose driver's
    21  license has been surrendered to the department because of a
    22  suspension or revocation of an operating privilege under this or
    23  any other title. Program participants in the Address
    24  Confidentiality Program under 23 Pa.C.S. Ch. 67 may use a
    25  substitute address designated by the Office of Victim Advocate
    26  as their address. The identification card shall be designed and
    27  manufactured in the same manner and of the same components as a
    28  driver's license and shall have substantially the same content
    29  as a driver's license but shall clearly indicate that it is not
    30  a driver's license. Upon failure of any person to pass any

     1  examination required under section 1514 (relating to expiration
     2  and renewal of drivers' licenses), the department shall, where
     3  appropriate, issue a complimentary identification card as an
     4  expression of gratitude for years of safe driving. The card
     5  shall only be issued upon receipt of the person's driver's
     6  license.

     8     Section 3.  Section 1610(a) of Title 75 is amended to read:
     9  § 1610.  Commercial driver's license.
    10     (a)  Content of license.--The commercial driver's license
    11  shall indicate "commercial driver's license" or ["CDL"] "CDL,"
    12  shall comply with the design and manufacturer's standards under
    13  section 1510(a) and (a.1) (relating to issuance and content of
    14  driver's license) and the smart card technology requirements
    15  under section 1510(a.1) and (a.2) and shall include, but not be
    16  limited to, the [following information:
    17         (1)  The name and residential address of the person.
    18         (2)  The person's color photograph or photographic
    19     facsimile.
    20         (3)  A physical description of the person, including sex,
    21     height and eye color.
    22         (4)  Date of birth.
    23         (5)  The license number assigned by the department.
    24         (6)  The person's signature or a facsimile of that
    25     signature.
    26         (7)  The] class or type of commercial motor vehicle or
    27     vehicles which the person is authorized to drive, together
    28     with any endorsements or restrictions.

    30     Section 4.  The Department of Transportation shall provide a

     1  schedule to phase in the new drivers' licenses over a four-year
     2  period which follows the expiration dates for drivers' licenses
     3  issued on and after January 1, 2009.
     4     Section 5.  This act shall take effect July 1, 2007, or
     5  immediately, whichever is later.
