                                     AN ACT

     1  Amending the act of July 16, 1968 (P.L.351, No.173), entitled,
     2     as amended, "An act authorizing the establishment of prisoner
     3     pre-release centers and release plans under the jurisdiction
     4     of the Department of Justice and defining its powers and
     5     duties," further providing for release plans.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 2(a) of the act of July 16, 1968
     9  (P.L.351, No.173), referred to as the Prisoner Pre-release Plan
    10  Law, amended December 27, 1974 (P.L.933, No.325), is amended to
    11  read:
    12     Section 2.  Release Plan for Prison Inmates.--(a)  The
    13  Commissioner of Correction may transfer any person incarcerated
    14  in any pre-release center or in any pre-release center located
    15  in any State or Regional Penal or Correctional Institution under
    16  the supervision of the Bureau of Correction who has not been
    17  sentenced to death or life imprisonment, to any pre-release
    18  center under the supervision of the Department of Justice[.]


     1  provided the pre-release center in which the person is
     2  incarcerated immediately prior to his release from any State or
     3  regional penal or correctional institution under the supervision
     4  of the Bureau of Correction is within fifty miles of the county
     5  where the individual was most recently prosecuted.

     7     Section 2.  This act shall take effect in 60 days.
