                                     AN ACT

     1  Establishing a pilot program to provide for automated
     2     enforcement of meeting or overtaking school bus requirements
     3     in a selected school district.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Automated
     8  Enforcement System on School Buses Pilot Program Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Department."  The Department of Transportation of the
    14  Commonwealth.
    15     "Program."  The Automated Enforcement System on School Buses
    16  Pilot Program established in section 3.
    17  Section 3.  Establishment of pilot program.
    18     The department is authorized to establish and administer the

     1  Automated Enforcement System on School Buses Pilot Program
     2  during the 2007-2008 school year. The program shall provide for
     3  the enforcement of 75 Pa.C.S. § 3345 (relating to meeting or
     4  overtaking school bus) by recording violations using an
     5  automated enforcement system designed to be installed on school
     6  buses and approved by the department. The department shall:
     7         (1)  Develop and publicize an application procedure for
     8     school districts interested in participating in the program.
     9         (2)  Select one school district to participate in the
    10     program from the list of applicant school districts.
    11         (3)  Make available a one-time grant to the school
    12     district selected to fund the implementation and operation of
    13     the automated enforcement system under this act in the 2007-
    14     2008 school year. The grant shall not exceed $100,000 or be
    15     derived from the Motor License Fund.
    16         (4)  Monitor and evaluate the program and present a
    17     report of the evaluation to the Transportation Committee of
    18     the Senate and the Transportation Committee of the House of
    19     Representatives.
    20  Section 4.  Expiration.
    21     This act shall expire June 30, 2008.
    22  Section 5.  Effective date.
    23     This act shall take effect immediately.
