           MELIO, O'NEILL, SAINATO, SCAVELLO, VEREB, WOJNAROSKI AND
           YOUNGBLOOD, FEBRUARY 1, 2007

                                     AN ACT

     1  Amending the act of October 10, 1974 (P.L.705, No.235), entitled
     2     "An act providing for the training and licensing of watch
     3     guards, protective patrolmen, detectives and criminal
     4     investigators, carrying and using lethal weapons in their
     5     employment; imposing powers and duties on the Commissioner of
     6     the Pennsylvania State Police; and providing penalties,"
     7     further providing for education and training program.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 4(b) of the act of October 10, 1974
    11  (P.L.705, No.235), known as the Lethal Weapons Training Act,
    12  amended November 23, 1976 (P.L.1155, No.254), is amended to
    13  read:
    14     Section 4.  Education and Training Program.--* * *
    15     (b)  All privately employed agents, except those who have
    16  been granted a waiver from compliance herewith by the
    17  commissioner and those who have certification under 42 Pa.C.S.
    18  Ch. 29 (relating to officers serving process and enforcing
    19  orders), who, as an incidence to their employment, carry a


     1  lethal weapon shall be required to attend the program
     2  established by subsection (a) of this section in accordance with
     3  the requirements or regulations established by the commissioner
     4  and, upon satisfactory completion of such program, shall be
     5  entitled to certification by the commissioner.

     7     Section 2.  This act shall take effect in 60 days.
