        INTRODUCED BY MUSTO, MELLOW, BOSCOLA, FONTANA, STOUT,

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for payments to
     6     intermediate units, for special education payments to school
     7     districts and for extraordinary special education program
     8     expenses.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Sections 2509.1 and 2509.5 of the act of March
    12  10, 1949 (P.L.30, No.14), known as the Public School Code of
    13  1949, are amended by adding subsections to read:
    14     Section 2509.1.  Payments to Intermediate Units.--* * *
    15     (b.14)  Up to ten million seven hundred and fifty thousand
    16  dollars ($10,750,000) may be utilized for programs administered
    17  and operated by intermediate units during the 2006-2007 school
    18  year for institutionalized children as established in subsection
    19  (b.1).

     1     Section 2509.5.  Special Education Payments to School
     2  Districts.--* * *
     3     (rr)  During the 2006-2007 school year, each school district
     4  shall be paid the amount it received during the 2005-2006 school
     5  year under subsections (pp) and (qq).
     6     (ss)  During the 2006-2007 school year, twenty-two million
     7  four hundred sixty-seven thousand and nine hundred seventy
     8  dollars ($22,467,970) of the funds appropriated to the
     9  Department of Education for special education shall be used to
    10  provide supplemental funding for special education to all school
    11  districts. Each school district shall receive a funding
    12  supplement calculated as follows:
    13     (1)  multiply each school district's 2006-2007 market
    14  value/income aid ratio by sixteen percent (16%) of its 2005-2006
    15  average daily membership;
    16     (2)  multiply the product from paragraph (1) by twenty
    17  million nine hundred forty-three thousand and five hundred
    18  dollars ($20,943,500); and
    19     (3)  divide the resultant product from paragraph (2) by the
    20  sum of the products of the 2006-2007 market value/income aid
    21  ratio multiplied by sixteen percent (16%) of the 2005-2006
    22  average daily membership for all school districts.
    23     (tt)  Each school district shall receive an inflation index
    24  supplement as necessary so that the amounts under subsection
    25  (ss) and this subsection equal three and nine-tenths percent
    26  (3.9%) multiplied by each school district's 2006-2007 market
    27  value/income aid ratio of the amount in subsection (rr).
    28     (uu)  Each school district for which the sum of the
    29  supplements under subsections (ss) and (tt) provides an amount
    30  less than two percent (2%) of the amount provided under

     1  subsection (rr) shall receive additional funding as necessary so
     2  that the sum of the amounts provided under subsections (ss),
     3  (tt) and this subsection equals two percent (2%) of the amount
     4  provided under subsection (rr).
     5     Section 2.  Section 2509.8(e) of the act, added December 23,
     6  2003 (P.L.304, No.48), is amended and the section is amended by
     7  adding a subsection to read:
     8     Section 2509.8.  Extraordinary Special Education Program
     9  Expenses.--* * *
    10     (e)  For the 2003-2004 [school year and each school year
    11  thereafter], 2004-2005 and 2005-2006 school years, the
    12  Department of Education shall set aside one percent (1%) of the
    13  special education appropriation for extraordinary expenses
    14  incurred in providing a special education program or service to
    15  one or more students with disabilities as approved by the
    16  Secretary of Education. Such special education program or
    17  service shall include, but not be limited to, the transportation
    18  of students with disabilities; services related to occupational
    19  therapy, physical therapy, speech and language, hearing
    20  impairments or visual impairments; or training in orientation
    21  and mobility for children who are visually impaired or blind.
    22     (f)  For the 2006-2007 school year and each school year
    23  thereafter, the Department of Education shall set aside two
    24  percent (2%) of the special education appropriation for
    25  extraordinary expenses incurred in providing a special education
    26  program or service to one or more students with disabilities as
    27  approved by the Secretary of Education.
    28     Section 3.  This act shall take effect immediately.
