        SENATOR GREENLEAF, JUDICIARY, AS AMENDED, JUNE 13, 2006

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of
     3     endangering the welfare of children.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4304(a) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 4304.  Endangering welfare of children.
     9     (a)  Offense defined.--A parent, guardian, or other person     <--
    10  supervising the welfare of a child under 18 years of age or such
    11  person's employer or supervisor commits an offense if he
    12  knowingly or recklessly endangers the welfare of the child by
    13  violating a duty of care, protection or support.

    15     (A)  OFFENSE DEFINED.--                                        <--
    16         (1)  A PARENT, GUARDIAN, OR OTHER PERSON SUPERVISING THE
    17     WELFARE OF A CHILD UNDER 18 YEARS OF AGE OR A PERSON WHO
    18     EMPLOYS OR SUPERVISES SUCH A PERSON COMMITS AN OFFENSE IF HE

     1     KNOWINGLY OR RECKLESSLY ENDANGERS THE WELFARE OF THE CHILD BY
     2     VIOLATING A DUTY OF CARE, PROTECTION OR SUPPORT.
     3         (2)  A PERSON COMMITS AN OFFENSE IF THE PERSON, IN AN
     4     OFFICIAL CAPACITY, PREVENTS OR INTERFERES WITH THE MAKING OF
     5     A REPORT OF SUSPECTED CHILD ABUSE UNDER 23 PA.C.S. CH. 63
     6     (RELATING TO CHILD PROTECTIVE SERVICES).
     7         (3)  AS USED IN THIS SUBSECTION, THE TERM "PERSON
     8     SUPERVISING THE WELFARE OF A CHILD" MEANS A PERSON OTHER THAN
     9     A PARENT OR GUARDIAN WHO PROVIDES CARE, EDUCATION, TRAINING
    10     OR CONTROL OF A CHILD.

    12     Section 2.  This act shall take effect in 60 days.
