AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, providing for the removal of snow and ice from 3 certain vehicles. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Title 75 of the Pennsylvania Consolidated 7 Statutes is amended by adding a section to read: 8 § 3720. Snow and ice removal. 9 (a) General rule.--Any driver of a motor vehicle being 10 operated on any street or highway of this Commonwealth shall 11 have an affirmative duty to make all reasonable efforts to 12 remove all accumulated ice or snow from the motor vehicle, 13 including the hood, trunk and roof of the motor vehicle. Any 14 driver of a motor vehicle who violates this section may be 15 stopped on a street or highway by a law enforcement officer if 16 the law enforcement officer believes the accumulated ice or snow 17 may pose a threat to persons or property. Any person who 18 violates this section shall be subject to a fine of not less
1 than $25 nor more than $75 for each offense regardless of 2 whether any snow or ice is dislodged from the vehicle. 3 (b) Dislodged snow and ice.--When snow or ice is dislodged 4 from a moving vehicle and strikes another vehicle or pedestrian 5 causing injury or property damage, the following penalties shall 6 apply: 7 (1) The operator of a noncommercial motor vehicle shall 8 be subject to a fine of not less than $200 nor more than 9 $1,000 for each offense. 10 (2) The operator of a commercial motor vehicle shall be 11 subject to a fine of not less than $500 nor more than $1,500 12 for each offense. 13 (c) Exception.--This section shall not apply to any driver 14 of a motor vehicle operated during a snow or ice storm that 15 began and continued for the duration of the motor vehicle's 16 operation or to any operator of a motor vehicle while it is 17 parked. 18 Section 2.
