        INTRODUCED BY TOMLINSON, CONTI, RAFFERTY, TARTAGLIONE,
           GREENLEAF, PILEGGI, ERICKSON, THOMPSON, M. WHITE, BOSCOLA,
           LOGAN, COSTA, PUNT, WENGER, WAUGH, C. WILLIAMS, WONDERLING
           AND STACK, SEPTEMBER 29, 2005

        AS AMENDED ON THIRD CONSIDERATION, NOVEMBER 21, 2005

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for police animals.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 5511.2(d) of Title 18 of the Pennsylvania
     6  Consolidated Statutes is amended to read:
     7  § 5511.2.  Police animals.
     8     * * *
     9     (d)  Definitions.--As used in this section, the following
    10  words and phrases shall have the meanings given to them in this
    11  subsection:
    12     "Accelerant detection dog."  A dog which is trained for
    13  accelerant detection, commonly referred to as arson canines.
    14     "Bomb detection dog."  A dog which is trained to locate a
    15  bomb or explosives by scent.
    16     "Narcotic detection dog."  A dog which is trained to locate
    17  narcotics by scent.

     1     "Police animal."  An animal, including, but not limited to,
     2  dogs and horses, used by the Pennsylvania State Police, the
     3  Southeastern Pennsylvania Transportation Authority (SEPTA)
     4  Police Department, the police department of the Port Authority    <--
     5  of Allegheny County A POLICE DEPARTMENT created pursuant to the   <--
     6  act of April 6, 1956 (1955 P.L.1414, No.465), known as the
     7  Second Class County Port Authority Act, the Department of
     8  Corrections, a county facility or office or by a municipal
     9  police department, fire department, search and rescue unit or
    10  agency or handler under the supervision of such department,
    11  search and rescue unit or agency in the performance of the
    12  functions or duties of such department, search and rescue unit
    13  or agency, whether the animal is on duty or not on duty. The
    14  term shall include, but not be limited to, an accelerant
    15  detection dog, bomb detection dog, narcotic detection dog,
    16  search and rescue dog and tracking animal.
    17     "Search and rescue dog."  A dog which is trained to locate
    18  lost or missing persons, victims of natural or manmade disasters
    19  and human bodies.
    20     "Tracking animal."  An animal which is trained to track or
    21  used to pursue a missing person, escaped inmate or fleeing
    22  felon.
    23     Section 2.  This act shall take effect in 60 days.
