        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           JULY 1, 2006

                                     AN ACT

     1  Amending Title 23 (Domestic Relations) of the Pennsylvania
     2     Consolidated Statutes, FURTHER PROVIDING FOR WILLFUL FAILURE   <--
     3     TO PAY SUPPORT ORDER; AND providing for court-appointed child
     4     custody health care or behavioral health practitioners.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 23 of the Pennsylvania Consolidated          <--
     8  Statutes is amended by adding a section to read:
     9     SECTION 1.  SECTION 4354(A) OF TITLE 23 OF THE PENNSYLVANIA    <--
    10  CONSOLIDATED STATUTES IS AMENDED TO READ:
    11  § 4354.  WILLFUL FAILURE TO PAY SUPPORT ORDER.
    12     (A)  OFFENSE DEFINED.--AN INDIVIDUAL WHO WILLFULLY FAILS TO
    13  COMPLY WITH A SUPPORT ORDER OF A COURT OF THIS COMMONWEALTH WHEN
    14  THE INDIVIDUAL HAS THE FINANCIAL ABILITY TO COMPLY WITH THE
    15  SUPPORT ORDER COMMITS A [SUMMARY OFFENSE] MISDEMEANOR OF THE
    16  THIRD DEGREE.

    18     SECTION 2.  TITLE 23 IS AMENDED BY ADDING A SECTION TO READ:

     1  § 5315.  Court-appointed child custody health care or behavioral
     2             health practitioners.
     3     No party to a child custody matter in which the court has
     4  appointed a licensed health care or behavioral health
     5  practitioner to assist the court by conducting an examination or
     6  evaluation of the parties involved or making a recommendation
     7  concerning a child custody agreement or order may be permitted
     8  to file a complaint against the practitioner with the
     9  practitioner's State licensing board prior to the final
    10  agreement or order being issued and for 60 days thereafter. As
    11  used in this section, "licensed health care or behavioral health
    12  practitioner" means a person who is licensed, certified,
    13  accredited or otherwise regulated by the Commonwealth to provide
    14  health care or behavioral health services.
    15     SECTION 3.  THE AMENDMENT OF 23 PA.C.S. § 4354(A) SHALL APPLY  <--
    16  TO OFFENSES COMMITTED ON OR AFTER THE EFFECTIVE DATE OF THIS
    17  SECTION.
    18     Section 2 4.  This act shall take effect in 60 days.           <--
