SENATE BILL

           LAVALLE, PIPPY, COSTA, TOMLINSON, RAFFERTY, LOGAN, BOSCOLA

                                     AN ACT

     1  Amending the act of June 21, 1939 (P.L.566, No.284), entitled
     2     "An act defining the liability of an employer to pay damages
     3     for occupational disease contracted by an employe arising out
     4     of and in the course of employment; establishing an elective
     5     schedule of compensation; providing procedure for the
     6     determination of liability and compensation thereunder;
     7     imposing duties on the Department of Labor and Industry, the
     8     Workmen's Compensation Board, Workmen's Compensation
     9     Referees, and deans of medical schools; creating a medical
    10     board to determine controverted medical issues; establishing
    11     an Occupational Disease Fund in custody of the State
    12     Workmen's Insurance Board; imposing upon the Commonwealth a
    13     part of the compensation payable for certain occupational
    14     diseases; making an appropriation; and prescribing
    15     penalties," providing further benefits; and making an
    16     appropriation.

    17     The General Assembly of the Commonwealth of Pennsylvania
    18  hereby enacts as follows:
    19     Section 1.  Section 301 of the act of June 21, 1939 (P.L.566,
    20  No.284), known as The Pennsylvania Occupational Disease Act, is
    21  amended by adding a subsection to read:
    22     Section 301.  * * *
    23     (m)  Every person heretofore or hereafter qualified for
    24  additional compensation under the provisions of clause (2) of


     1  subsection (a) or subsection (i) shall, beginning with the month
     2  following the effective date of this subsection, or the month of
     3  qualification, whichever occurs later, be paid further
     4  compensation of twenty-five dollars ($25) per month during the
     5  period of disability. Such further compensation paid to a person
     6  heretofore or hereafter qualified shall be paid by the
     7  Commonwealth.
     8     Section 2.  The sum of $250,000 is appropriated to the
     9  Department of Labor and Industry for fiscal year 2005-2006 to
    10  carry out the provisions of this act. This appropriation is in
    11  addition to any other appropriation authorized to the Department
    12  of Labor and Industry for the fiscal period July 1, 2005, to
    13  June 30, 2006.
    14     Section 3.  This act shall take effect in 60 days.
