SENATE BILL

No. 596 Session of 2005

                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor and the Pennsylvania
     3     Historical and Museum Commission, to accept by donation a
     4     tract of land and any improvements thereon situate in the
     5     Borough of Ambridge, Beaver County.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Conveyance in Ambridge Borough, Beaver County.
     9     (a)  Acquisition authority.--The Department of General
    10  Services, with the approval of the Governor and the Pennsylvania
    11  Historical and Museum Commission, is hereby authorized on behalf
    12  of the Commonwealth of Pennsylvania to accept by donation from
    13  the Harmonie Associates, Inc., a tract of land and any
    14  improvements thereon described in subsection (b).
    15     (b)  Property description.--The tract of land to be donated
    16  by Harmonie Associates, Inc., pursuant to this section, is
    17  located in the Borough of Ambridge, County of Beaver, bounded
    18  and described as follows:
    19  ALL that certain lot of land situate in the Fourth Ward of the

     1  Borough of Ambridge, Beaver County, Pennsylvania, being Lot No.
     2  11 in Block No. 8 upon the Village Plan as recorded in Beaver
     3  County Plan Book Volume 1, page 241, bounded and described as
     4  follows, to-wit:
     5  BEGINNING at the southeasterly corner of Church Street and
     6  Fourteenth Street; thence eastwardly along the southerly line of
     7  Fourteenth Street, 42.2 feet to the dividing line common to Lot
     8  Nos. 10 and 11 in said Block, thence southwardly along said
     9  dividing line 70 feet to the northerly line of property of the
    10  German Lutheran Church; thence westwardly along the northerly
    11  line of said Church property, 42.8 feet to the easterly line of
    12  Church Street, thence northwardly along the easterly line of
    13  Church Street, 70 feet to the southerly line of Fourteenth
    14  Street at the place of beginning.
    15  CONTAINING an area of approximately 0.07 acres.
    16     (c)  Easements, etc.--The donation shall be made under and
    17  subject to all recordable easements, servitudes and rights of
    18  others, including, but not confined to, streets, roadways and
    19  rights of any telephone, telegraph, water, electric, cable,
    20  sewer, gas or pipeline companies, as well as under and subject
    21  to any recordable interest, estates or tenancies vested in third
    22  persons, appearing of record, for any portion of the land or
    23  improvements erected thereon.
    24     (d)  Deed.--The deed shall be prepared by the grantor as
    25  provided by law, subject to approval by the Department of
    26  General Services, and accepted on behalf of the Commonwealth of
    27  Pennsylvania by the Department of General Services.
    28     (e)  Costs and fees.--Costs and fees incidental to this
    29  donation shall be borne by the grantee, unless otherwise
    30  stipulated by previous agreement.

     1  Section 2.  Effective date.
     2     This act shall take effect in 60 days.
