           TOMLINSON, BOSCOLA, LEMMOND, ERICKSON, RAFFERTY, TARTAGLIONE,
           RHOADES, WOZNIAK, COSTA, KASUNIC, WAUGH AND FERLO,
           MARCH 31, 2005

                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," providing for programs by
    21     the Department of Health for persons suffering from
    22     Alzheimer's disease.

    23     The General Assembly of the Commonwealth of Pennsylvania
    24  hereby enacts as follows:
    25     Section 1.  The act of April 9, 1929 (P.L.177, No.175), known
    26  as The Administrative Code of 1929, is amended by adding a
    27  section to read:

     1     Section 2126.  Alzheimer's Disease Programs.--(a)  The
     2  Department of Health shall have the power, and its duty shall
     3  be:
     4     (1)  To develop a program to provide respite service programs
     5  to persons suffering from Alzheimer's disease or related
     6  disorders of aging.
     7     (2)  To administer the programs, contract with other public
     8  or private organizations or make grants to provide services
     9  under this section for respite and related services which may
    10  include:
    11     (i)  diagnostic and evaluation programs;
    12     (ii)  day-care centers;
    13     (iii)  temporary care in nursing or boarding homes of other
    14  institutions; or
    15     (iv)  in-home visiting or temporary nursing services.
    16     (3)  To develop rules and regulations to standardize the
    17  necessary qualifications of respite service programs for
    18  assistance, determine the eligibility of families or individuals
    19  for assistance and develop a system of evaluation and review of
    20  all programs.
    21     (b)  No grant, contract or other funding shall be allocated
    22  or distributed until the Department of Health has received
    23  verification of the existence of private funds committed to the
    24  program or service for which the funds are to be allocated. No
    25  allocation shall exceed the amount of private funding available.
    26     (c)  As used in this section, the term "respite service
    27  program" means a program to assist individuals or families who
    28  are providing primary care for an individual with Alzheimer's
    29  disease or a related disorder of aging by providing temporary
    30  care and assistance to the patient, individual or family.
