                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, defining "combat zone;" and further
     3     providing for limitations in educational assistance program.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3201 of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a definition to read:
     8  § 3201.  Definitions.
     9     The following words and phrases when used in this chapter
    10  shall have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:

    13     "Combat zone."  An area designated by Presidential Executive
    14  order as a combat zone as described in section 7508 of the
    15  Internal Revenue Code of 1986 (Public Law 99-514, 26 U.S.C. §
    16  7508).

     2     Section 2.  Section 3206 of Title 51 is amended to read:
     3  § 3206.  Limitations.
     4     (a)  Time.--[No]
     5         (1)  Except as otherwise provided in paragraph (2), no
     6     member shall be eligible for full-time or part-time student
     7     assistance grants or a combination thereof under this chapter
     8     for a total of more than five academic years or their
     9     equivalent as determined by the agency.
    10         (2)  For any member who served on active duty in a combat
    11     zone, eligibility for such grants shall be extended for a
    12     period not less than one year and no greater than one
    13     additional month for each month or part of month of such
    14     service.
    15     (b)  Active duty.--[No]
    16         (1)  Except as otherwise provided in paragraph (2), no
    17     grant payments shall be made under this chapter except during
    18     the eligible member's term of service as a member in good
    19     standing of the Pennsylvania National Guard.
    20         (2)  For eligible members who were called or ordered to
    21     active Federal service or active State duty under section 508
    22     (relating to active State duty for emergency) after September
    23     11, 2001, the deadline for making grant payments shall be
    24     extended for one additional month for each month or part of
    25     month of such service after the member is discharged or
    26     released under honorable conditions from the Pennsylvania
    27     National Guard.
    28     Section 3.  This act shall take effect in 60 days.
