           ORIE, O'PAKE, D. WHITE, COSTA, GREENLEAF, WOZNIAK, LEMMOND,
           BOSCOLA AND WONDERLING, FEBRUARY 18, 2005

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for reimbursement of
     6     certain school district mailing expenses; and making an
     7     appropriation.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding a
    12  section to read:
    13     Section 116.  Reimbursement of Certain School District
    14  Mailing Expenses.--(a)  A school district of the first class A,
    15  second class, third class or fourth class shall be eligible to
    16  receive reimbursement from the Department of Education for the
    17  cost of two first class mailings for the fiscal year 2004-2005
    18  as required under section 341(a) of the act of July 5, 2004
    19  (P.L.654, No.72), known as the "Homeowner Tax Relief Act."
    20     (b)  An eligible school district shall receive an amount

     1  equal to the product of the cost of first-class postage and the
     2  total number of notices mailed in fiscal year 2004-2005 under
     3  section 341(a) of the "Homeowner Tax Relief Act."
     4     (c)  An eligible school district shall provide the Department
     5  of Education with a notarized statement certifying the number of
     6  notices mailed in fiscal year 2004-2005 under section 341(a) of
     7  the "Homeowner Tax Relief Act."
     8     (d)  The Department of Education shall provide an eligible
     9  school district that provides the statement required under
    10  subsection (c) with a reimbursement equal to the amount
    11  calculated under subsection (b).
    12     Section 2.  The sum of $3,000,000 is hereby appropriated to
    13  the Department of Education for the purpose of making
    14  reimbursements to eligible school districts as set forth in
    15  section 116 of the act.
    16     Section 3.  This act shall take effect in 60 days.
