                                     AN ACT

     1  Amending the act of June 1, 1945 (P.L.1242, No.428), entitled
     2     "An act relating to roads, streets, highways and bridges;
     3     amending, revising, consolidating and changing the laws
     4     administered by the Secretary of Highways and by the
     5     Department of Highways relating thereto," providing for
     6     reclamation of certain bridges in counties of the sixth class
     7     formerly part of the State highway system.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of June 1, 1945 (P.L.1242, No.428), known
    11  as the State Highway Law, is amended by adding a section to
    12  read:
    13     Section 223.  Reclamation of Bridges in Counties of the Sixth
    14  Class Formerly Part of the State Highway System.--In any county
    15  of the sixth class containing a bridge with a span between 25
    16  and 27 feet in length that has been continuously maintained by
    17  the municipality in which the bridge is located since November
    18  23, 1981, the municipality may return the maintenance, repair
    19  and improvement obligation and expense of the bridge to the
    20  Commonwealth by ordinance or resolution passed by the

     1  municipality. After passage of such an ordinance or resolution,
     2  the bridge shall become part of the State highway system and
     3  shall be maintained, repaired and improved by the Department of
     4  Transportation. This section shall not be construed as creating
     5  any maintenance, repair or improvement obligation relating to
     6  the road leading to or from any bridge subject to this section.
     7     Section 2.  This act shall take effect in 60 days.
