SENATE BILL

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for employment of
     6     school health personnel.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1410 of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949, added
    11  July 15, 1957 (P.L.937, No.404), is amended to read:
    12     Section 1410.  Employment of School Health Personnel.--(a)
    13  Except as otherwise provided in this article, all school
    14  districts alone or jointly with other districts or joint school
    15  boards shall employ school physicians and school dentists but
    16  only with the approval of the Secretary of Health, and shall
    17  compensate them on a basis agreed upon by the school physician
    18  or school dentist and the employing district or joint school
    19  board, and shall employ one or more school nurses. Health


     1  officers of municipalities may be appointed as school physicians
     2  by school districts or joint school boards. For special
     3  examinations recommended by school physicians, school districts
     4  or joint school boards may engage the services of
     5  [ophthamologists] ophthalmologists or other licensed medical
     6  specialists or of optometrists. Any school district alone or
     7  jointly with other districts or joint school boards may employ
     8  dental hygienists and such other technical and clerical
     9  personnel as are necessary to carry out the provisions of this
    10  article.
    11     (b)  School nurses who are not CPR certified by a Department
    12  of Health-approved certifying agency by July 1, 2006, shall
    13  complete CPR training within one year. Persons hired for a
    14  position as a school nurse after July 1, 2006, shall be CPR
    15  certified or complete CPR certification through a Department of
    16  Health-approved certifying agency within one year of their hire
    17  date. School nurses shall complete CPR recertification within
    18  the time frame established by the approved certifying agency.
    19     Section 2.  This act shall take effect immediately.
