SENATE BILL

No. 158 Session of 2005

                                     AN ACT

     1  Adding a certain portion of the Bayfront Parkway in the City of
     2     Erie, Erie County, to the State Highway System, and
     3     transferring to the City of Erie a certain State road.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Transfer of roads.
     7     (a)  Authorization.--
     8         (1)  Upon publication of the notice required in
     9     subsection (c), that portion of Bayfront Parkway, in the City
    10     of Erie, Erie County, beginning at the existing Lincoln
    11     Avenue heading in an easterly direction to Sixth Street, for
    12     a distance of 21,124 feet or 4.00 miles, is hereby adopted as
    13     a State highway, to be known as State Route 290.
    14         (2)  That State Route 4018, in the City of Erie, Erie
    15     County, for a distance of 31,283 feet or 5.925 miles, is
    16     hereby transferred to the City of Erie, subject to approval
    17     by resolution of the city council. The city council shall,
    18     within 14 days of the adoption of such resolution, transmit

     1     notice thereof to the Department of Transportation.
     2     (b)  Release of liability.--Upon publication of the notice
     3  required in subsection (c):
     4         (1)  The City of Erie, Erie County, is hereby relieved of
     5     all responsibility for maintenance of that portion of
     6     Bayfront Parkway as described in subsection (a)(1).
     7         (2)  The Commonwealth is hereby relieved of all
     8     responsibility for maintenance of the State Route 4018 as
     9     described in subsection (b)(1).
    10     (c)  Publication.--The Department of Transportation shall
    11  publish notice of approval of the transfer by the city council
    12  as provided in subsection (a)(2) to the Legislative Reference
    13  Bureau as a notice in the Pennsylvania Bulletin. The publication
    14  shall occur within 30 days of the notice of approval to the
    15  department.
    16  Section 2.  Effective date.
    17     This act shall take effect in 60 days.
