                                     AN ACT

     1  Amending Title 35 (Health and Safety) of the Pennsylvania
     2     Consolidated Statutes, imposing a penalty for failure of
     3     local officials of a municipality to notify municipality
     4     residents of impending or occurring disasters and emergencies
     5     affecting the local municipality.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 35 of the Pennsylvania Consolidated
     9  Statutes is amended by adding a section to read:
    10  § 7503.1.  Penalty for failure to warn residents.
    11     (a)  Imposition.--A violation by a political subdivision of
    12  section 7503(9) (relating to powers and duties of political
    13  subdivisions) that results in losses to a resident of the
    14  political subdivision shall be punishable by a fine in the
    15  amount of the damages incurred. The fine shall be awarded to the
    16  aggrieved party.
    17     (b)  Procedure.--The district attorney shall enforce the
    18  fine.
    19     Section 2.  This act shall take effect in 60 days.
