AN ACT
1 Amending Title 35 (Health and Safety) of the Pennsylvania
2 Consolidated Statutes, imposing a penalty for failure by the
3 agency to notify local officials about impending or occurring
4 disasters and emergencies affecting the local municipality.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Title 35 of the Pennsylvania Consolidated
8 Statutes is amended by adding a section to read:
9 § 7313.1. Penalty for failure to warn local municipality.
10 (a) Imposition.--A violation by the agency of section
11 7313(6) (relating to powers and duties) that results in losses
12 to a political subdivision or its residents shall be punishable
13 by a fine in the amount of the damages incurred. The fine shall
14 be awarded to the political subdivision, and the political
15 subdivision shall allocate the proceeds of the fine among the
16 aggrieved parties.
17 (b) Procedure.--The district attorney shall enforce the
18 fine.
19 Section 2. This act shall take effect in 60 days.
