                                     AN ACT

     1  Amending the act of October 6, 2005 (P.L.319, No.59), entitled,
     2     "An act amending the act of June 24, 1976 (P.L.424, No.101),
     3     entitled, as amended, 'An act providing for the payment of
     4     death benefits to the surviving spouse or children or parents
     5     of firefighters, ambulance service or rescue squad members,
     6     law enforcement officers or National Guard members killed in
     7     the performance of their duties,' further providing for death
     8     benefit eligibility and for definitions," further providing
     9     for retroactivity of death benefit eligibility.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 4 of the act of October 6, 2005 (P.L.319,
    13  No.59), entitled, "An act amending the act of June 24, 1976
    14  (P.L.424, No.101), entitled, as amended, 'An act providing for
    15  the payment of death benefits to the surviving spouse or
    16  children or parents of firefighters, ambulance service or rescue
    17  squad members, law enforcement officers or National Guard
    18  members killed in the performance of their duties,'" is amended
    19  to read:
    20     Section 4.  The amendment or addition of section 1(a.1), (d)
    21  and (e) of the act shall apply retroactively to include any

     1  [certificate] certification of death of an eligible firefighter,
     2  ambulance service or rescue squad member, law enforcement
     3  officer or National Guard member who died as a result of the
     4  performance of his or her duties [filed] submitted to the
     5  Commonwealth under section 1(a) of the act on or after December
     6  15, 2003.
     7     Section 2.  This act shall take effect immediately.
