                                     AN ACT

     1  Restricting the authority of the Environmental Quality Board
     2     over fuel additives; and abrogating a regulation.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Fuel Additive
     7  Regulatory Control Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Board."  The Environmental Quality Board.
    13  Section 3.  Prohibition.
    14     Notwithstanding section 5(7) of the act of January 8, 1960
    15  (1959 P.L.2119, No.787), known as the Air Pollution Control Act,
    16  the board does not have authority to promulgate regulations
    17  mandating the sale or use of specifications for motor fuel


     1  prescribed by the State of California.
     2  Section 4.  Abrogation of regulation.
     3     The provisions of 25 Pa. Code Ch. 126 Subch. D (relating to
     4  new motor vehicle emissions control program) are abrogated.
     5  Section 10.  Effective date.
     6     This act shall take effect in 60 days.
