AN ACT 1 Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An 2 act relating to insurance; amending, revising, and 3 consolidating the law providing for the incorporation of 4 insurance companies, and the regulation, supervision, and 5 protection of home and foreign insurance companies, Lloyds 6 associations, reciprocal and inter-insurance exchanges, and 7 fire insurance rating bureaus, and the regulation and 8 supervision of insurance carried by such companies, 9 associations, and exchanges, including insurance carried by 10 the State Workmen's Insurance Fund; providing penalties; and 11 repealing existing laws," requiring all health insurance 12 policies to provide coverage for student vaccinations. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. The act of May 17, 1921 (P.L.682, No.284), known 16 as The Insurance Company Law of 1921, is amended by adding a 17 section to read: 18 Section 635.2. Coverage for Student Vaccinations.--(a) As 19 used in this section "health insurance policies" means all group 20 or individual health or sickness or accident insurance policies 21 providing hospital or medical/surgical coverage and all group or 22 individual subscriber contracts or certificates issued by any
1 entity subject to one of the following: 2 (1) this act; 3 (2) the act of December 29, 1972 (P.L.1701, No.364), known 4 as the "Health Maintenance Organization Act"; 5 (3) 40 Pa.C.S. Ch. 61 (relating to hospital plan 6 corporations); or 7 (4) 40 Pa.C.S. Ch. 63 (relating to professional health 8 services plan corporations). 9 (b) All health insurance policies offered, issued or renewed 10 after the effective date of this section shall provide coverage 11 for college and university students required to receive a one- 12 time vaccination against meningococcal disease as required by 13 the act of June 28, 2002 (P.L.492, No.83), known as the "College 14 and University Student Vaccination Act." 15 (c) This section does not include the following: 16 (1) accident only; 17 (2) limited benefit; 18 (3) credit; 19 (4) dental; 20 (5) vision; 21 (6) specified disease; 22 (7) Medicare supplement; 23 (8) Civilian Health and Medical Program of the Uniformed 24 Services (CHAMPUS) supplement; 25 (9) long-term care or disability income; 26 (10) workers' compensation; 27 (11) automobile medical payment; or 28 (12) any combination of hospital indemnity, accident only, 29 fixed indemnity, credit, dental, vision, specified disease, 30 Medicare supplement, Civilian Health and Medical Program of the 20050H2097B2899 - 2 -
1 Uniformed Services (CHAMPUS) supplement, long-term care or 2 disability income, workers' compensation or automobile medical 3 payment insurance, or other limited benefit plan. 4 Section 2. This act shall take effect in 60 days. G13L40JLW/20050H2097B2899 - 3 -
