AN ACT 1 Amending the act of February 1, 1966 (1965 P.L.1656, No.581), 2 entitled "An act concerning boroughs, and revising, amending 3 and consolidating the law relating to boroughs," further 4 providing for COLLECTIONS OF ASSESSMENTS AND FOR <-- 5 intergovernmental cooperation, joint ownership and 6 maintenance. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 2711 of the act of February 1, 1966 (1965 <-- 10 P.L.1656, No.581), known as The Borough Code, is amended to 11 read: 12 SECTION 1. SECTIONS 2007 AND 2711 OF THE ACT OF FEBRUARY 1, <-- 13 1966 (1965 P.L.1656, NO.581), KNOWN AS THE BOROUGH CODE, ARE 14 AMENDED TO READ: 15 SECTION 2007. COLLECTIONS OF ASSESSMENTS.--IF THE OWNERS OF 16 PROPERTY AGAINST WHICH A FOOT-FRONT ASSESSMENT HAS BEEN MADE 17 SHALL REFUSE TO PAY SUCH ASSESSMENT WITHIN [THIRTY] NINETY DAYS 18 AFTER NOTICE OF THE SAME, IT SHALL BE THE DUTY OF THE BOROUGH
1 SOLICITOR TO COLLECT THE SAME, WITH INTEREST FROM THE TIME OF 2 COMPLETION OF THE IMPROVEMENT, BY ACTION OF ASSUMPSIT, OR BY 3 LIEN TO BE FILED AND COLLECTED IN THE SAME MANNER AS MUNICIPAL 4 CLAIMS. WHEN AN OWNER HAS TWO OR MORE LOTS AGAINST WHICH THERE 5 IS AN ASSESSMENT FOR THE SAME IMPROVEMENT, ALL OF SUCH LOTS MAY 6 BE EMBRACED IN ONE CLAIM. 7 Section 2711. Intergovernmental Cooperation, Joint Ownership 8 and Maintenance.--[Any two or more boroughs, or a borough with 9 any city or township, or a borough with a county, may jointly 10 acquire property for, and operate and maintain, any recreation 11 places. Any borough or boroughs shall have power to join with 12 any school district in equipping, operating and maintaining 13 recreation places, and may appropriate money therefor.] (a) For 14 the purpose of acquiring property for creating, equipping, 15 operating or maintaining a park, playground, playfield, 16 gymnasium, public bath, swimming pool or indoor recreation 17 center or public recreation area and similar facility or program 18 for public use, the borough may cooperate or join with any one <-- 19 or more of any of the following: 20 (1) A local government in accordance with 53 Pa.C.S. Ch. 23 21 Subch. A (relating to intergovernmental cooperation). 22 (2) A nonprofit corporation. 23 (b) A borough cooperating or joining with a nonprofit 24 corporation, as authorized under subsection (a) and except as 25 otherwise provided by law, shall comply with applicable 26 statutory requirements governing competitive bidding, written or 27 telephonic price quotations and execution of contracts. 28 Section 2.
