                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     report by district attorney.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 9561 of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 9561.  Report by district attorney.
     9     (a)  Reports by district attorneys of felony and sexual
    10  offense convictions against health care professionals.--Whenever
    11  a health care professional has been found guilty, has pleaded
    12  guilty or has entered a plea of nolo contendere to a felony or
    13  to a sexual offense in this Commonwealth, the district attorney
    14  of the county in which the case was prosecuted shall notify the
    15  appropriate State board within 30 days of the court's entry of a
    16  finding of guilt, acceptance of a guilty plea or acceptance of a


     1  plea of nolo contendere.
     2     (b)  Definitions.--The following words and phrases when used
     3  in this section shall have the meanings given to them in this
     4  subsection unless the context clearly indicates otherwise:
     5     "Health care professional."  A person licensed, certified or
     6  registered by any of the State boards as defined in this
     7  section.
     8     "State board."  Includes the following departmental
     9  administrative boards within the Department of State:
    10         [the] (1)  The State Board of Medicine.[, the]
    11         (2)  The State Board of Osteopathic Medicine.[, the]
    12         (3)  The State Board of Dentistry.[, the]
    13         (4)  The State Board of Podiatry.[, the]
    14         (5)  The State Board of Pharmacy.[, the]
    15         (6)  The State Board of Nursing.[, the]
    16         (7)  The State Board of Physical Therapy.[, the]
    17         (8)  The State Board of Occupational Therapy Education
    18     and Licensure.[, the]
    19         (9)  The State Board of [Optometrical Examiners]
    20     Optometry.[, the]
    21         (10) The State Board of Examiners of Nursing Home
    22     Administrators.[, the]
    23         (11)  The State Board of [Chiropractic Examiners]
    24     Chiropractic.[, the]
    25         (12)  The State Board of [Psychologist Examiners]
    26     Psychology. [and the]
    27         (13)  The State Board of Examiners in Speech-Language and
    28     Hearing.
    29         (14)  The State Board of Social Workers, Marriage and
    30     Family Therapists and Professional Counselors.

     1     "Sexual offense."  An offense as set forth in 18 Pa.C.S.
     2  (relating to crimes and offenses) in any of the following:
     3         Section 2910 (relating to luring a child into a motor
     4     vehicle).
     5         Chapter 31 (relating to sexual offenses).
     6         Section 5901 (relating to open lewdness).
     7         Section 5903 (relating to obscene and other sexual
     8     materials and performances).
     9         Section 6312 (relating to sexual abuse of children).
    10         Section 6318 (relating to unlawful contact with minor).
    11         Section 6320 (relating to sexual exploitation of
    12     children).
    13     Section 2.  This act shall take effect in 60 days.
