                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of
     3     gasoline price hiking.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7331.  Gasoline price hiking.
     9     (a)  Offense defined.--A person who owns or operates a
    10  gasoline retail establishment and raises the price of a gallon
    11  of gasoline more than once in a 24-hour period commits an
    12  offense.
    13     (b)  Penalty.--A person who violates this section commits:
    14         (1)  For a first violation, a summary offense and shall,
    15     upon conviction, be sentenced to pay a fine of not less than
    16     $250 nor more than $1,000.

     1         (2)  For a second or subsequent violation, a misdemeanor
     2     of the third degree and shall, upon conviction, be sentenced
     3     to pay a fine of not less than $1,000 nor more than $5,000 or
     4     to imprisonment for not more than 90 days, or both.
     5     (c)  Definitions.--As used in this section, the following
     6  words and phrases shall have the meanings given to them in this
     7  subsection:
     8     "Gasoline."  Fuels, liquid fuels and diesel fuels as defined
     9  under 75 Pa.C.S. § 9002 (relating to definitions).
    10     "Gasoline retail establishment."  A facility that dispenses
    11  gasoline directly to members of the public for use in vehicles
    12  that operate on the highways of this Commonwealth.
    13     Section 2.  This act shall take effect in 60 days.
