                                     AN ACT

     1  Amending Title 71 (State Government) of the Pennsylvania
     2     Consolidated Statutes, providing for annual supplemental
     3     annuities for State Police.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 71 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 5708.9.  Annual supplemental annuities for State Police.
     9     (a)  General rule.--Every annuitant who retired as an officer
    10  or member of the Pennsylvania State Police and who is in receipt
    11  of a superannuation, withdrawal or disability annuity shall
    12  continue to receive the annuity, and beginning July 1, 2006, and
    13  annually thereafter, a cost-of-living supplement shall be
    14  payable to such annuitant whose annuity has been in effect for
    15  at least 24 consecutive months. Any cost-of-living supplement
    16  provided in this subsection shall be payable under the same

     1  terms and conditions as provided under the option plan in effect
     2  as of June 30 of the year preceding the adjustment. No cost-of-
     3  living supplement shall be payable to an annuitant receiving a
     4  withdrawal annuity prior to his attainment of superannuation
     5  age.
     6     (b)  Cumulative benefit.--The annual supplemental annuities
     7  established under subsection (a) shall be in addition to the
     8  supplemental annuities provided for in sections 5708 (relating
     9  to supplemental annuities), 5708.1 (relating to additional
    10  supplemental annuities), 5708.2 (relating to further additional
    11  supplemental annuities), 5708.3 (relating to supplemental
    12  annuities commencing 1994), 5708.5 (relating to supplemental
    13  annuities commencing 1998), 5708.7 (relating to supplemental
    14  annuities commencing 2003) and the special supplemental
    15  postretirement adjustments provided for in sections 5708.4
    16  (relating to special supplemental postretirement adjustment) and
    17  5708.8 (relating to special supplemental postretirement
    18  adjustment of 2002).
    19     (c)  Source of funding.--The annual supplemental annuities
    20  established under subsection (a) shall be paid from the State
    21  Police benefit account identified under section 5936 (relating
    22  to State Police benefit account).
    23     Section 2.  This act shall take effect immediately.
