                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, prohibiting the use of a laser pointer
     3     under certain circumstances; and prescribing a penalty.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 5518.  Use of a laser pointer.
     9     (a)  Offense defined.--A person commits an offense if that
    10  person knowingly, with the intent to harass, annoy or alarm,
    11  shines a laser pointer at another person.
    12     (b)  Grading.--
    13         (1)  Except as provided in paragraph (2), an offense
    14     under subsection (a) is a summary offense.
    15         (2)  If the offense in subsection (a) is committed
    16     against a person operating a motor vehicle, vessel or
    17     aircraft, the offense shall be a misdemeanor of the third

     1     degree.
     2     (c)  Definition.--As used in this section, the term "laser
     3  pointer" means a handheld device that emits a laser beam.
     4     Section 2.  This act shall take effect in 60 days.
