        SENATOR PIPPY, GAME AND FISHERIES, IN SENATE, AS AMENDED,
           JUNE 20, 2006

                                     AN ACT

     1  Amending Title 30 (Fish) of the Pennsylvania Consolidated
     2     Statutes, restricting the transport, sale, importation or
     3     release of snakehead NON-NATIVE INJURIOUS fish.                <--

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 30 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 2508.  Restrictions on transport, sale, importation or release
     9             of snakehead NON-NATIVE INJURIOUS fish.                <--
    10     (a)  General rule.--No person shall transport, sell, offer
    11  for sale or release in this Commonwealth or import, bring or
    12  cause to be brought or imported into this Commonwealth a
    13  snakehead fish of the genus Channa or the genus Ophicephalus.     <--
    14     (b)  Construction.--Possession of a snakehead fish of the
    15  genus Channa or the genus Ophicephalus shall be subject to

     1  prosecution under section 2102(a) and (c) (relating to rules and
     2  regulations). NON-NATIVE INJURIOUS FISH.                          <--
     3     (B)  REGULATIONS.--THE COMMISSION SHALL PROMULGATE
     4  REGULATIONS PERTAINING TO NON-NATIVE INJURIOUS FISH.
     5     (c)  Penalty.--Any person who violates this section commits a
     6  misdemeanor of the third degree.
     7     Section 2.  The provisions of 30 Pa.C.S. § 2102 are repealed   <--
     8  insofar as they are inconsistent with this act.
     9     Section 3 2.  This act shall take effect in 60 days.           <--
