AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for 21 deputy secretaries. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. Section 2001.3 of the act of April 9, 1929 25 (P.L.177, No.175), known as The Administrative Code of 1929, 26 amended June 22, 1982 (P.L.573, No.166), is amended to read: 27 Section 2001.3. Deputy Secretaries.--(a) The Secretary of
1 Transportation shall appoint, with the approval of the Governor, 2 six deputy secretaries who shall have the title of Deputy 3 Secretary for Administration, Deputy Secretary for Highway 4 Administration, Deputy Secretary for [Safety Administration] 5 Driver and Vehicle Services, Deputy Secretary for Planning, 6 Deputy Secretary for Local and Area Transportation and Deputy 7 Secretary for Aviation, Rail Freight, Ports and Waterways. 8 (b) The Deputy Secretary for Administration, with the 9 approval of the Secretary of Transportation, shall have the 10 powers and perform the duties and functions under this act 11 regarding the fiscal affairs of the department, the management 12 information systems, office services, personnel, and operations 13 analysis and improvement. 14 (c) The Deputy Secretary for Highway Administration, with 15 the approval of the Secretary of Transportation shall have the 16 powers and perform the functions and duties provided in sections 17 2002 through 2009 of this act regarding the design, 18 construction, maintenance and land acquisition of State 19 designated highways and shall assure that the design, 20 maintenance, operation and replacement of highways will be such 21 as to protect health and minimize danger to life or property[.] 22 and shall conduct a continuing study of means to prevent 23 accidents and injuries on highways. 24 (d) The Deputy Secretary for [Safety Administration] Driver 25 and Vehicle Services, with the approval of the Secretary of 26 Transportation [shall conduct a continuing study of means to 27 prevent accidents and injuries on the highways], shall have the 28 powers and perform the duties and functions [heretofore imposed 29 upon and] performed by the Bureau of Motor Vehicles [in the 30 Department of Revenue] and the Bureau of [Traffic Safety in the 20050H1286B1530 - 2 -
1 Department of Revenue and shall exercise such powers and duties 2 with regard to safety in other modes of transportation as may be 3 prescribed by law.] Driver Licensing. 4 (e) The Deputy Secretary for Planning, with the approval of 5 the Secretary of Transportation shall have the powers and 6 perform the functions and duties provided in this act with 7 regard to environment, conservation, health, recreation and 8 social considerations, transportation planning statistics, 9 economic research, program and budget and advance planning. 10 (f) The Deputy Secretary for Local and Area Transportation, 11 with the approval of the Secretary of Transportation shall have 12 the powers and perform the functions and duties provided in 13 sections 2002 and 2003 regarding services to municipalities, 14 local and public transportation, planning, development and 15 funding of local and public transportation, technological 16 development of rail, water or other modes of transportation 17 (except recreational boating and ferry licensing), environmental 18 design, improvement of transportation services and shall perform 19 the functions and duties heretofore imposed upon and performed 20 by the Mass Transportation Division in the Bureau of Community 21 Development of the Department of Community Affairs, by the 22 Secretary of Community Affairs under the act of January 22, 1968 23 (P.L.42, Act No.8), known as the "Pennsylvania Urban Mass 24 Transportation Law," by the Department of Commerce in regard to 25 High-Speed Rail Demonstration Programs and by the former 26 Department of Highways in regard to the distribution of liquid 27 fuels taxes to the municipalities and townships. 28 (g) The Deputy Secretary for Aviation, Rail Freight, Ports 29 and Waterways, with the approval of the Secretary of 30 Transportation, shall have the powers and perform the functions 20050H1286B1530 - 3 -
1 and duties as provided by law relating to the department's 2 responsibilities for aviation, airports [and], air safety, rail 3 freight, rail safety and ports and waterways within the 4 Commonwealth. 5 Section 2. This act shall take effect in 60 days. B25L71MSP/20050H1286B1530 - 4 -
