                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for extension of
     3     employee benefits for military membership or duty.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 7309(c) of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 7309.  Employment discrimination for military membership or
     9             duty.

    11     (c)  Extension of benefits during military duty.--Whenever a
    12  member of the Pennsylvania National Guard is called or ordered
    13  into active Federal service or active State duty under orders
    14  authorized by law or a member of any reserve component is called
    15  or ordered onto active duty, other than active duty for
    16  training, the public or private employer of the member shall, at

     1  no cost to the member, continue health insurance and other
     2  benefits in effect for at least the first 30 days of the
     3  military duty. After the expiration of the first 30 days, the
     4  public or private employer shall provide the member of the
     5  Pennsylvania National Guard or other reserve component the same
     6  health insurance and other benefits in such manner as would have
     7  been enjoyed if the member had continued in such employment
     8  continuously for at least the next 150 days of the military
     9  duty. After the expiration of the first 180 days, the public or
    10  private employer shall give the member of the National Guard or
    11  other reserve component the voluntary option of continuing such
    12  health insurance and other benefits in effect at his own expense
    13  by paying for the insurance or benefits at the same rates paid
    14  by the employer, and the insurance coverage shall continue,
    15  except for injuries incurred in the line of military duty.
    16     Section 2.  This act shall take effect in 60 days.
