                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, establishing the Military Family
     3     Relief Fund and its operation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 51 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7319.  Contributions to Military Family Relief Fund.
     9     (a)  Creation of fund.--In order to carry out the purposes of
    10  section 315.8 of the act of March 4, 1971 (P.L.6, No.2), known
    11  as the Tax Reform Code of 1971, there is hereby established
    12  under the State Treasurer a special fund, which shall be known
    13  as the Military Family Relief Fund.
    14     (b)  Administration.--
    15         (1)  The department, in cooperation with the State

     1     Treasurer, shall administer the fund and shall accept
     2     voluntary contributions from persons for the fund.
     3         (2)  Contributions received for the fund shall be
     4     distributed by the department to Pennsylvania resident
     5     servicemen or servicewomen or their families that have
     6     suffered a sudden or unexpected loss of income or other
     7     source of support or a death or an illness of a family member
     8     that creates a direct and immediate demonstrable financial
     9     need for assistance in order to provide themselves and their
    10     families with food, shelter, clothing, required medical care
    11     and other necessities of life.
    12         (3)  Persons applying for assistance from the fund must
    13     physically reside in this Commonwealth and demonstrate that
    14     they have applied for and been turned down for existing
    15     relief programs as determined by the department.
    16     (c)  Rules.--The department shall develop rules and
    17  regulations necessary to administer the provisions of this
    18  chapter.
    19     (d)  Moneys received.--All moneys received from the voluntary
    20  contribution system established in section 315.8 of the Tax
    21  Reform Code of 1971 shall be deposited in the fund.
    22     (e)  Future appropriations.--The General Assembly may, from
    23  time to time, appropriate funds into the special fund for the
    24  purposes of this section.
    25     (f)  Use of fund money.--The moneys contained in the fund are
    26  continuously appropriated to the Department of Military and
    27  Veterans Affairs for the exclusive use of carrying out the
    28  purposes of this section.
    29     Section 2.  This act shall take effect immediately.
